Request City Council to 1) Adopt Resolution No. 8084 Approving Parcel Map 19680 for the Subdivision of Three (3) Parcels of Land (APN 0240-191-34, 0240-191-35 & 0240-191-43), Located at the Northwest Corner of Alder Avenue and Renaissance Parkway, into Four (4) Developable Parcels and One (1) Non-developable Remainder Parcel; and 2) Authorize the City Manager to Execute all Related Documents.

BACKGROUND

On January 26, 2017, the City of Rialto Planning Commission conditionally approved Tentative Parcel Map (TPM) No. 19680.  TPM No. 19680 shows the subdivision of three (3) parcels of land (APNs 0240-191-34, 0240-191-35 & 0240-191-43), located at the northwest corner of Alder Avenue and Renaissance Parkway, into four (4) parcels and one (1) remainder parcel.  The proposed parcels are in the Freeway Commercial (FC) zone of the Renaissance Specific Plan.  The project site contains 4.92 acres of land and is surrounded by Renaissance Parkway to the south, SR-210 Freeway to the north, vacant land to the west, and Alder Avenue to the east. 

 

On August 22, 2017, the City Council conditionally approved TPM 19680 based on the Planning Commission’s recommendation.  A copy of the City Council staff report is included as Attachment 1.

 

ANALYSIS/DISCUSSION

Sater Bros. (the “Applicant”), care of ALRAHAMAN, LLC, requests that the City Council approve Parcel Map 19680 to subdivide three (3) parcels of land (APNs 0240-191-34, 0240-191-35 & 0240-191-43), located at the northwest corner of Alder Avenue and Renaissance Parkway, into four (4) developable parcels and one (1) non-developable remainder parcel for the development of an 80,000 square-foot commercial center.  In conjunction with the development, the Applicant has received City Council approval for the Conditional Development Permit (CDP) Nos. 781, 782, and 783, to develop a gas service station, a convenience store, and sale of beer and wine for off-site consumption, respectively.  The Applicant also received Planning Commission approval on June 29, 2022, for CDP No. 2021-0025 to construct additional fueling pumps and canopy.  A copy of Parcel Map 19680 is included as Attachment 2

 

ALRAHAMAN, LLC, as the “Subdivider,” is developing the commercial center and constructing the required public improvements; however, the Subdivider has not completed the required public improvements associated with Parcel Map 19680 and has submitted an executed Subdivision Improvement Agreement to guarantee the completion of the remaining public improvements.  A copy of the Subdivision Improvement Agreement is included as Attachment 3.  A copy of the Disclosure Statement is included as Attachment 4.

 

The City Engineer determined that the conditions of approval associated with Tentative Parcel Map 19680 have been satisfied and that Parcel Map 19680 is in substantial conformance with Tentative Parcel Map 19680, and that Parcel Map 19680 is ready for City Council approval.

 

Approval of a Parcel Map is a ministerial action, and the City Council cannot condition its approval of the Parcel Map and cannot impose new conditions on the project that were not previously identified at the time the Tentative Parcel Map was approved.

 

ENVIRONMENTAL IMPACT

On February 23, 2021, the City Council approved an Addendum to the Renaissance Specific Plan 2010 Final Environmental Impact Report (Environmental Assessment Review No. 15- 47) for the project in accordance with the California Environmental Quality Act (CEQA). No further environmental review is required for the project. Copies of the Addendum and supporting environmental documents are available for review at the Community Development Department, Planning Division.

 

GENERAL PLAN CONSISTENCY

The project is consistent with the following goals of the Land Use Element of the Rialto General Plan:

 

Goal 2-19:                     Encourage neighborhood preservation, stabilization, and property maintenance.

 

Goal 2-21:                     Ensure high-quality planned developments in Rialto.

 

LEGAL REVIEW

The City Attorney has reviewed and supports this staff report, Resolution, and Subdivision Improvement Agreement.

 

FINANCIAL IMPACT

Operating Budget Impact

Completion of public improvements adds an estimated value of $459,262.80 to the City street system based on the Governmental Accounting Standards Board 34 (GASB34) for this specific project. 

 

Capital Improvement Budget Impact

The proposed action will not affect the City’s Capital Improvement Budget.

 

Licensing

Before execution of any issued On-Site or Off-Site Construction Permits, the Subdivider secured a business license application and paid a Business License tax at the Contractors rate, as well as Administration and State fees for his contractors performing any improvements and shall renew accordingly.

 

RECOMMENDATION

Staff requests that City Council:

 

1)                     Adopt a Resolution approving Parcel Map 19680 for the subdivision of three (3) parcels into four (4) developable parcels of land and one (1) non-developable remainder parcel to facilitate the development of an 80,000 square-foot commercial center; and

2)                     Authorize the City Manager to execute all related documents.
