Request City Council to (1) Accept the Traffic Signal at Pepper Avenue and Winchester Drive/Terrace Road, City Project No. 190802; (2) Authorize an Additional $5,759.48 for Construction Contract Change Orders; (3) Authorize Filing of the Notice of Completion; and (4) Authorize Release of Retention to KDC, Inc. (DBA Dynalectric).

BACKGROUND:

On September 24, 2019, the City Council awarded a construction contract to KDC, Inc. (DBA Dynalectric) in the amount of $285,150 for construction of a Traffic Signal at Pepper Avenue and Winchester Drive/Terrace Road, City Project No. 190802.

 

ANALYSIS/DISCUSSION:

On May 13, 2021, KDC, Inc. (DBA Dynalectric) satisfactorily completed the Traffic Signal at Pepper Avenue and Winchester Drive/Terrace Road.  The project included installation of a new traffic signal, traffic striping, pavement markings, and traffic signs.  Staff conducted a final inspection and found the work to comply with the plans, specifications, and standards of the City of Rialto.  Upon acceptance by City Council, staff will file a Notice of Completion for recordation at the County Recorder’s office.  A copy of the Notice of Completion is included as Attachment 1.

 

Table 1 below summarizes the total construction costs for the project.

 

 

Staff recommends that the City Council approve Contract Change Order No. 1 and 2 in the amount of $5,759.48 for a total contract amount of $290,909.47.

 

Project budget remaining to date is in the amount of $2,609.88. Staff is requesting an additional $3,109.60 be appropriated from Measure I Fund 201 for Contract Change Orders in the amount of $5,759.48 in order to complete the project.

 

 

A copy of Contract Change Order No. 1 is included as Attachment 2.  A copy of Contract Change Order No. 2 is included as Attachment 3.

 

ENVIRONMENTAL IMPACT:

Section 21084 of the California Public Resources Code requires that the guidelines for implementation of the California Environmental Quality Act (CEQA) include a list of classes of projects that have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA.  In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment and are declared categorically exempt from the requirement for the preparation of environmental documents.  In accordance with 14 CCR Section 15301 “Existing Facilities”, Class 1 projects consist of the repair, maintenance, or minor alteration of existing highways and streets, sidewalks, gutters, and similar facilities.  As minor alteration of existing public facilities, the Traffic Signal at Pepper Avenue and Winchester Drive/Terrace Road, City Project No. 190802 is considered categorically exempt from CEQA.  Staff has prepared and filed a Notice of Exemption for the project, which is included as Attachment 4.

 

GENERAL PLAN CONSISTENCY:

This action is consistent with Guiding Principle 3A in the General Plan:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Approval of this action also complies with the City of Rialto General Plan Goal and Policies:

 

Goal 3-6:                     Require that all developed areas within Rialto are adequately served with essential public services and infrastructure.

 

Goal 3-7:                     Upgrade public infrastructure as an inducement to promote private investment.

 

Goal 4-1:                     Provide transportation improvements to reduce traffic congestion associated with regional and local trip increases.

 

LEGAL REVIEW:

The City Attorney has reviewed and supports this staff report and Notice of Completion.

 

FINANCIAL IMPACT:

Operating Budget Impact

The new traffic signal will add approximately $1,000 annually to the Traffic Signal Maintenance Contract.

 

Capital Improvement Budget Impact

The project budget, incurred expenditures, and other associated costs are identified in Table 2.

The construction contract was awarded in the amount of $285,150.  The total construction cost including final Contract Change Orders of $5,759.48 is  $290,909.47. 

 

The additional authorization requested in the amount of $3,110 is available in the Measure I Fund Account No. 201-500-4310-3001.

 

The City is holding retention of $14,545.47 for KDC, Inc. (DBA Dynalectric) pending acceptance of the improvements and filing of the Notice of Completion with the County Recorder’s office.

 

The project included construction of a new traffic signal and related traffic striping, pavement markings, and traffic signs; therefore, the Finance Department will add the value of the new improvements to the City’s fixed asset system in compliance with the Government Accounting Standard Board (GASB) 34 Standards for Financial Reporting of Infrastructure Assets.  The GASB 34 worksheet is included as Attachment 5.

 

Licensing

The proposed action does not require payment of a business license tax.

 

RECOMMENDATION:

Staff recommends that the City Council:

 

                     Accept the Traffic Signal at Pepper Avenue and Winchester Drive/Terrace Road, City Project No. 190802.

                     Authorize an Additional $5,759.48 for Construction Contract Change Orders.

                     Authorize the City Engineer to file the Notice of Completion with the County Recorder’s Office.

                     Authorize release of retention to KDC, Inc. (DBA Dynalectric).
