RECOMMENDATION

Staff recommends that the City Council:

 

1.                     Award a Construction Contract to CAT Tracking, Inc. in the amount of $146,750 for the Class II Bike Lanes Project, Federal Project No. HSIP 5205-024, City Project No.170813; and

2.                     Authorize the City Manager or their Designee to execute all related documents.

 

BACKGROUND

On July 31, 2015, staff submitted a grant application for the Highway Safety Improvement Program (HSIP) Cycle 7 from the Federal Statewide Transportation Improvement Plan (FSTIP) to improve safety for bicycle traffic along Merrill Avenue from the eastern City Limits to the western City limits and on South Riverside Avenue from Slover Avenue to Agua Mansa Road. The HSIP provides funding to implement safety improvements on public roads, aiming to reduce fatalities and serious injuries through targeted infrastructure upgrades and safety initiatives with a focus on pedestrian/bicycle safety.

 

On August 22, 2017, the City Council accepted the HSIP Cycle 7 grant in the amount of $196,200 with a required local match of $21,800 and amended the Capital Improvement Program to include this capital project. 

 

On January 23, 2018, the City Council awarded a Professional Services Agreement with KOA Corporation for the Engineering Design of the Bike Lanes Project.

 

On January 10, 2023, the City Council authorized the release of a Request for Bids (RFB) for the Construction of the Bike Lanes Project. On June 23, 2023, the City released the RFB, receiving only one bid. 

 

On January 9, 2024, the City Council rejected the single bid, which exceeded the available project funding, and directed staff to reduce the project scope by eliminating the proposed bike lanes on Riverside Avenue.  Further, Council direction was given to readvertise the project for construction bids for 1.25 miles of Class III Bike Lanes on Merrill Avenue from Lilac Avenue to Eucalyptus Avenue and Install 1.5 miles of Class II Bike Lanes on Merrill from Maple Avenue to Lilac Avenue.

 

ANALYSIS/DISCUSSION

The current Bike Lanes Project scope of work will install 1.5 miles of Class II Bike Lanes on Merrill Avenue from Maple Avenue to Lilac Avenue and 1.25 miles of Class III bike lanes on Merrill Avenue from Lilac Avenue to Eucalyptus Avenue.  An exhibit of the current scope of work is included as Attachment 1.

 

On February 27, 2024, the City released RFB No. 24-017 Construction of Class II Bike Lanes Project, Federal Project No. HSIP 5205-024, City Project No.170813, and published the Notice Inviting Bids in the San Bernardino Sun Newspaper and on the PlanetBids.com website.  On March 28, 2024, the City received five bids as follows:

 

 

A complete bid summary is included as Attachment 2.  The engineer’s estimate was $170,500.  Staff reviewed the bid and found CAT Tracking Inc. to be properly licensed and qualified.  CAT Tracking, Inc.’s Disclosure Statement, Contractor’s License, and DIR Verification documents are included as Attachment 3.  Staff recommends that the City Council accept the bid received from CAT Tracking, Inc. as the lowest responsible and responsive bid.  A construction contract with CAT Tracking, Inc. for the project is included as Attachment 4.

 

ENVIRONMENTAL IMPACT

On February 1, 2021, Caltrans, as the lead agency, pursuant to the National Environmental Policy Act (NEPA), made an environmental determination that this project qualifies for a Categorical Exclusion in accordance with 23 CFR 771.117(c), pursuant to activity(c)(3).

 

The City, as the lead agency pursuant to the California Environmental Quality Act (CEQA), determined this Project is Categorically Exempt from CEQA pursuant to Section 15301 “Existing Facilities,” pursuant to Class 1(c). A Notice of Exemption was filed on June 25, 2018, included as Attachment 5.

 

GENERAL PLAN CONSISTENCY

This action is consistent with Guiding Principle 3A in the General Plan:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Approval of this action also complies with the following City of Rialto General Plan Goals and Policies:

Goal 4-8:                     Establish and maintain a comprehensive system of pedestrian trails and bicycle routes that provide viable connections throughout the city.

 

Policy 4-8.3:                     Connect school facilities, parks, and other activity nodes within residential neighborhoods with bicycle trails on neighborhood streets.

 

LEGAL REVIEW

The City Attorney’s Office has reviewed the agreement and approved it as to form.

 

FINANCIAL IMPACT

Operating Budget Impact

The proposed action will not affect the Operating Budget.

 

Capital Improvement Budget Impact

The project is currently funded by the federal Highway Safety Improvement Program (HSIP) grant in the Special Grant Project Fund Account No. 22234420-53001 in the amount of $158,120. A local match of $29,600 has been budgeted through the Measure I Fund Account No. 22014310-53001.

 

Funds in the amount of $123,110 are available in Account 22234420-53001 for the construction costs. Staff recommends a transfer of $23,640 from the Measure I Fund to the project to accommodate for the construction contract. The additional funds are available in the Measure I fund, Account No. 22014310-53001, and do not require the adoption of a budget resolution.

 

Funds to appropriate for the award of the construction contract CAT Tracking, Inc. in the amount of $146,750, will be available from the following two sources:

 

                     Special Grant Project Fund Account No. 22234420-53001-170813-05 in the amount of $123,110; and

                     Measure I Fund Account No. 22014310-53001-170813-22 in the amount of $23,640.

 

Licensing

CAT Tracking, Inc. will pay a business license tax in the amount of $204 prior to commencing the services for this project.
