ANALYSIS/DISCUSSION
Warmington Residential California, Inc. (the “Subdivider”) requests that the City Council approve Tract Map 20709 to consolidate 4.99 acres of land located on the northeast corner of Foothill Boulevard and Spruce Avenue within the Foothill Mixed-Use Zone (FMUZ) into one residential condominium lot consisting of eighty-one attached condominium dwelling units. A copy of Tract Map 20709 is included as Attachment 2. The surrounding public streets are complete with minor improvements that are required of this subdivision. The project is required to construct, but is not limited to, public improvements such as pavement restoration, on-site public sewer main, on-site public water main, and off-site drainage improvements. A copy of the Subdivision Improvement Agreement is included in Attachment 3. A copy of the Disclosure Statement is included in Attachment 4.
The City Engineer has determined that the conditions of approval associated with TTM 20709 have been satisfied, Tract Map 20709 is in substantial conformance with TTM 20709, and that Tract Map 20709 is ready for City Council approval.
Approval of a Tract Map is a ministerial action, and the City Council cannot condition its approval of the Tract Map and cannot impose new conditions on the project that were not previously identified at the time the Tentative Tract Map was approved.
