Request City Council to: (1) Adopt Resolution No. 8445 Approving Tract Map 20356 for the Subdivision of Three Parcels of Land Located at the Corner of Foothill Boulevard and Larch Avenue Within the Residential-High Density (R-HD) Zone of the Foothill Boulevard Specific Plan into Seven Lots for Condominium Purposes; and (2) Authorize the City Manager or Their Designee to Execute all Related Documents.

RECOMMENDATION
Staff recommends that the City Council:
1) Adopt a resolution approving Tract Map 20356 for the subdivision of three parcels of land located at the corner of Foothill Boulevard and Larch Avenue within the Residential-High Density (R-HD) zone of the Foothill Boulevard Specific Plan into seven lots for condominium purposes; and
2) Authorize the City Manager or their designee to execute all related documents.
BACKGROUND
On February 22, 2023, the City of Rialto Planning Commission conditionally approved Tentative Tract Map (TTM) No. 2022-0001, which had been assigned TTM No. 20356 by the San Bernardino County Recorder’s Office. A copy of the Planning Commission staff report is included as Attachment 1. TTM No. 20356 shows the subdivision of approximately 4.53 acres of land (APNs: 0128-071-02, -03, & -09) located at the corner of Foothill Boulevard and Larch Avenue within the Residential-High Density (R-HD) zone of the Foothill Boulevard Specific Plan into seven lots for condominium purposes.
ANALYSIS/DISCUSSION
Keystone DCS, Inc. (the “Subdivider”) requests that the City Council approve Tract Map 20356 to subdivide three parcels of land (APNs: 0128-071-02, -03, & -09) located at the corner of Foothill Boulevard and Larch Avenue within the Residential-High Density (R-HD) zone of the Foothill Boulevard Specific Plan into seven lots for condominium purposes. A copy of Tract Map 20356 is included as Attachment 2. The surrounding public streets are complete with minor improvements that are required of this subdivision. The project is required to construct, but is not limited to, public improvements such as pavement restoration, curb and gutter, sidewalk, streetlights, landscaping and irrigation, on-site public sewer main, and on-site public water main. The Subdivider has submitted a Subdivision Improvement Agreement, with necessary bonds, to guarantee completion of the remaining public improvements. A copy of the Subdivision Improvement Agreement is included in Attachment 3. A copy of the Disclosure Statement is included in Attachment 4.
The City Engineer has determined that the conditions of approval associated with TTM 20356 have been satisfied, Tract Map 20356 is in substantial conformance with TTM 20356, and that Tract Map 20356 is ready for City Council approval.
Approval of a Tract Map is a ministerial action, and the City Council cannot condition its approval of the Tract Map or impose new conditions on the project that were not previously identified at the time the TTM was approved.
ENVIRONMENTAL IMPACT
An Initial Study (Environmental Assessment Review No. 2022-0017) for the proposed project was prepared in accordance with the requirements of the California Environmental Quality Act (CEQA). Based on the findings and recommended mitigation within the Initial Study, staff determined that the project will not have an adverse impact on the environment, and a Mitigated Negative Declaration was prepared.
GENERAL PLAN CONSISTENCY
The project is consistent with the following goals of the Land Use Element of the Rialto General Plan:
Goal 2-16: Improve the architectural and design quality of development in Rialto.
Goal 2-20: Require high-quality multi-unit design, landscaping, and architecture.
Goal 2-21: Ensure high-quality planned developments in Rialto.
LEGAL REVIEW
The City Attorney’s Office has reviewed the resolution and approved it as to form.

Operating Budget Impact
The proposed action will not affect the City’s Operating Budget.
Capital Improvement Budget Impact
The proposed action will not affect the City’s Capital Improvement Budget.
Licensing
Before execution of any issued On-Site or Off-Site Construction Permits, the Subdivider secured a business license application and paid a Business License tax at the Contractor's rate, as well as Administration and State fees for his contractors performing any improvements, and shall renew accordingly.
