RECOMMENDATION
Staff requests that the City Council:
1) Adopt a resolution approving the Public Improvement Agreement for Precise Plan of Design 2023-0025; and
2) Authorize the City Manager or their designee to execute all related documents.
BACKGROUND
On April 9, 2024, the City of Rialto Community Development Director approved Precise Plan of Design No. 2023-0025, allowing the development of an Electric Truck Charging Center with 73 charging stations with additional improvements, including paving, landscaping, lighting, and drainage on approximately 3.88 acres of land (APN: 0258-121-09), subject to the findings and conditions therein. The development is located on the southwest corner of Riverside Avenue and Santa Ana Avenue, within the Heavy Industrial (H-IND) zone. A copy of the Community Development Director approval letter is included as Attachment 1.
ANALYSIS/DISCUSSION
OLAM S Riverside Ave LLC (the “Developer”) requests that the City Council approve the Public Improvement Agreement (PIA) for the construction of certain public improvements along Riverside Avenue and Santa Ana Avenue as required by the conditions of approval. The public improvements consist of, but are not limited to, the following: asphalt base, asphalt concrete, curb & gutter, sidewalk, streetlights, driveway approaches, landscaping & irrigation, undergrounding of overhead utilities, and signing & striping.
The Developer has submitted an executed PIA and security to guarantee the completion of the public improvements. A copy of the PIA is included as Attachment 2. A copy of the Disclosure Statement is included as Attachment 3.
ENVIRONMENTAL IMPACT
The project is categorically exempt per section 15332 of the California Environmental Quality Act Guidelines, Class 32, Infill Development Project.
GENERAL PLAN CONSISTENCY
The project is consistent with the following goals of the Land Use Element of the Rialto General Plan:
Goal 2-16: Improve the architectural and design quality of development in Rialto.
Goal 3-1: Strengthen and diversify the economic base and employment opportunities and maintain a positive business climate.
LEGAL REVIEW
The City Attorney’s Office has reviewed the resolution and Public Improvement Agreement approved it as to form.
FINANCIAL IMPACT
Operating Budget Impact
The proposed action will not affect the City’s Operating Budget.
Capital Improvement Budget Impact
The proposed action will not affect the City’s Capital Improvement Budget.
Licensing
Before execution of any issued on-site or off-site construction permits, the Contractor secured a business license application and paid a Business License tax at the Contractors rate, as well as Administration and State fees for his contractors performing any improvements and shall renew accordingly.
