Request City Council to Award a Construction Contract to KDC Inc., dba Dynalectric in the Amount of $285,150 for Construction of the Traffic Signal at Pepper Avenue and Winchester Drive/Terrace Road.

BACKGROUND:

In late 2014, Pepper Avenue was extended north of its terminus with Winchester Drive/Terrace Road providing a connection to Highland Avenue north of the SR-210 Freeway.  In Summer 2018, the freeway ramps at the SR-210 and Pepper Avenue were opened to the public to access Pepper Avenue.  The increased traffic on Pepper Avenue has resulted in challenges for the residents to navigate safely out of their neighborhood onto Pepper Avenue.  Currently, the intersection of the Pepper Avenue at Winchester Drive/Terrace Road is controlled by an All-Way stop control that was installed in Fall 2018, immediately after the freeway ramps were opened.  The All-Way stop control was installed to provide right of way assignment for vehicles turning out of the residential community and for school children to cross the intersection. 

 

The installation of the signal is recommended to enhance the overall intersection safety and operation and to provide a safe crossing for the school children from Frisbie Middle School using the existing crosswalk on the north side of the intersection; which will be signalized as part of the new traffic signal installation.  This stretch of Pepper Avenue carries a traffic volume in excess of 7,000 vehicles per day.  Since the opening of the Pepper Avenue Ramp at the SR-210, traffic volumes have increased southbound and northbound on Pepper Avenue; therefore, the signal installation will mitigate the impacts of the increased traffic and will enhance the overall safety for the general public.

 

ANALYSIS/DISCUSSION:

Construction Award:

On July 2, 2019, the City released RFB No.20-001 for the Construction of the Traffic Signal at Pepper Avenue and Winchester Drive/Terrace Road and posted it on PlanetBids.com.  On July 25, 2019, the City received 13 bids as shown in Table 1 below.  Public Works staff evaluated the bids, considering firm qualifications and costs.  Staff recommends awarding the contract to the lowest responsible bidder, KDC Inc., dba Dynalectric to construct the Traffic Signal Improvements.  The Construction Contract with KDC Inc., dba Dynalectric is included as Attachment 1.  The Bid Abstract and Bid Tabulation are included as Attachments 2 and 3.

 

Table 1 below summarizes the bid abstracts received from interested bidders.

During the three (3) weeks advertisement period, bidders submitted questions requesting clarification or qualification of the project, and the City addressed all questions via the two (2) Addenda posted on PlanetBids.com.

 

Following the bid opening, Public Works staff independently reviewed each bid for completeness of required information, individual work item costs, and base bid totals.  Staff evaluated the five (5) lowest bids, checking bid computations, prime and subcontractor licenses, Department of Industrial Relations (DIR) registration, presence or absence of State actions against prime or subcontractors, insurance coverage, previous project references, and other items.

 

After a detailed review of the bids, KDC Inc., dba Dynalectric was determined to be the lowest responsible and responsive bidder.  The engineers estimated construction cost range for the project is $275,000.00 to $305,000.00.  As noted, staff reviewed the bids, references, and contractor’s licenses, and found KDC Inc., dba Dynalectric properly licensed and qualified to construct the street improvements. 

 

Staff conducted a comprehensive background check and requested evaluations from the following three (3) agencies:

 

1.                     Traffic Signals Rehabilitation Project, City of Newport Beach - Contract Amount $208,587.00

2.                     MTA Universal Pedestrian Bridge Lighting, LAMTA - Contract Amount $324,580.00

3.                     Cerritos Avenue Widening Traffic Signal Modification and Street Lighting Improvements, City of Cypress - Contract Amount - $46,854.00

 

The evaluations demonstrated high ratings in categories such as Overall Performance/Quality/Delivery of the project, job completed within budget, and outstanding communications between the agencies and KDC Inc., dba Dynalectric.

 

Construction Management:

On June 11, 2019, the City Council approved a shortlist of “On-Call” consultants for construction management, inspection and material testing services with six (6) firms. Staff requested proposals for construction management, inspection and material testing for the project from the on-call consultants and received only five (5) proposals.  The City evaluated the proposals based on assigned staff qualifications to the project and hours delegated for each position based on 120 working days. 

 

Public Work staff recommends TKE Engineering Inc. to provide construction management services including materials testing.  TKE Engineering Inc., proposal and fees are included as Attachments 4 and 5.

 

ENVIRONMENTAL IMPACT:

Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act (CEQA).  The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA.  In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment and are declared categorically exempt from the requirement for the preparation of environmental documents.  In accordance with Section 15301 “Existing Facilities,” Class 1 projects consist of the maintenance of existing highways and streets; as a traffic signal installation project, the Project is considered categorically exempt from CEQA.  A Notice of Exemption will be filed pursuant to CEQA.

 

GENERAL PLAN CONSISTENCY:

This action is consistent with Guiding Principle 3A in the General Plan:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Approval of this action also complies with the following City of Rialto General Plan Goals and Policies:

 

Goal 3-6:                     Require that all developed areas within Rialto are adequately served with essential public services and infrastructure.

 

Goal 3-7:                     Upgrade public infrastructure as an inducement to promote private investment.

 

Goal 4-1:                     Provide transportation improvements to reduce traffic congestion associated with regional and local trip increases.

 

 

LEGAL REVIEW:

The City Attorney has reviewed and supports this staff report.

 

FINANCIAL IMPACT:

Operating Budget Impact

The proposed action will add approximately $1,000 annually to the Traffic Signal Maintenance Contract.

 

Capital Improvement Budget Impact

Table 2 below shows the project funding sources and related expenditures for the construction of the Traffic Signal at Pepper Avenue and Winchester Drive/Terrace Road, City Project No. 190802.

Award of the construction contract with KDC Inc, dba Dynalectric will be from the Measure I Fund Account No. 201-500-4310-3001-190802-05 in the amount of $285,150.

 

On June 11, 2019, the City Council approved a shortlist of “On-Call” consultants for construction management, inspection and material testing services including TKE Engineering, Inc., and issued a Purchase Order Number 2020-0385 to TKE Engineering, Inc. in the amount of $100,000.  Staff will utilize Purchase Order Number 2020-0385 for construction management and material testing for the Traffic Signal at Pepper Avenue and Winchester Drive/Terrace Road charging to the Measure I Fund Account No. 201-500-4310-3001-190802-16 in the amount of $37,648.

 

Licensing

Prior to execution of the Construction Contract, KDC Inc., dba Dynalectric shall submit a business license application and pay a Business License tax at the rate of $100, as well as Administration and State fees. Prior to execution of the Professional Services Agreement, TKE Engineering Inc. shall submit a business license application and pay a Business License tax at the rate of $104, as well as Administration and State fees.

 

RECOMMENDATION:

Staff recommends that the City Council to Award a contract to KDC Inc. dba Dynalectric in the amount of $285,150 for the construction of the Traffic Signal at Pepper Avenue and Winchester Drive/Terrace Road, City Project No. 190802.
