Title
Request City Council to Set a Public Hearing for August 8, 2023 to consider (1) Specific Plan Amendment No. 2022-0001, a request to change the land use designation on a 1.67-acre parcel of land (APN: 0130-013-02) located on the east side of Cactus Avenue approximately 360 feet south of Foothill Boulevard from Commercial - Mixed Use (C-MU) to Residential - High Density (R-HD), (2) Precise Plan of Design No. 2022-0025, a request to allow the development of a 21-unit apartment complex with 5 Accessory Dwelling Units consisting of eight (8) two-story buildings and associated paving, landscaping, lighting and drainage improvements, and (3) an Addendum to the Foothill Boulevard Specific Plan Mitigated Negative Declaration (Environmental Assessment Review No. 2022-0037) prepared for the project, in accordance with the California Environmental Quality Act (CEQA).

LOCATION:
The project site consists of one (1) parcel (APN: 0130-013-02) of land approximately 1.67 acres in size, located on the east side of Cactus Avenue approximately 360 feet south of Foothill Boulevard. A copy of the location map is attached as Exhibit A.
BACKGROUND:
Planning Commission Action
On April 26, 2023, at a regularly scheduled Planning Commission meeting, the Commission opened the public hearing, staff gave a staff report and took public comments. After discussion, the Commission closed the public hearing and voted 4-0 (1 absence & 2 vacancies) to adopt Resolutions recommending that the City Council approve the project. Copies of the Planning Commission Resolutions are attached as Exhibit B.
City Council Action
On June 13, 2023, at a regularly scheduled City Council meeting, the Council opened the public hearing, staff gave a staff report and took public comments. After discussion, the Council closed the public hearing and continued the item to a meeting date uncertain for reconsideration. As such, the public hearing will be re-noticed as required by state law.
ANALYSIS/DISCUSSION:
In accordance with Section 18.78.060G of the Rialto Municipal Code, the City Council is to set the matter for public hearing. A more comprehensive staff report will follow once the hearing has been set.
ENVIRONMENTAL IMPACT:
An Addendum to the Foothill Boulevard Specific Plan Mitigated Negative Declaration (Environmental Assessment Review No. 2022-0037) has been prepared for consideration in conjunction with the project.
LEGAL REVIEW:
The City Attorney has reviewed and approved the attached Notice of Public Hearing (Exhibit C).
RECOMMENDATION:
In accordance with the process provided by Section 18.78.060G of the Rialto Municipal Code, Staff recommends that the City Council set a Public Hearing for August 8, 2023, to consider the Project.
