Request City Council to Adopt Resolution No. 7381 Accepting the Fiscal Year 2018 Justice Assistance Grant (JAG) in the Amount of $28,457 and Approve the Inter-Local Agreement with the County of San Bernardino.

BACKGROUND:

Congress established the Justice Assistance Grant (JAG) Program in the 2005 Omnibus Appropriations Package. JAG blends the previous Byrne Formula Grant and Local Law Enforcement Block Grant (LLEBG) programs to provide agencies with the flexibility to prioritize and place justice funds where they are needed most.

 The minimum JAG formula considers base allocation as well as population and Part 1 violent crime statistics. Sixty percent (60%) of the State allocation is awarded to the State Administrative Agency (OES) and forty percent (40%) to eligible local governments. The City of Rialto has been awarded $28,457.

 

ANALYSIS/DISCUSSION:

JAG funds can be used for local initiatives; technical assistance, training, personnel, equipment or contractual support and information systems for criminal justice for any one or more of the following:

 

                     Law Enforcement programs

                     Prosecution and Court programs

                     Prevention and Education programs

                     Corrections and Community Corrections programs

                     Drug Treatment programs

                     Planning, Evaluation and Technology Improvement programs

                     Crime Victim and Witness Programs (other than compensation)

 

The City of Rialto has been certified to receive a disparate allocation.  A disparate allocation occurs when the allocation to the City exceeds 150% of the county’s allocation, or when the total of all Cities allocations exceed 400% of the county’s allocation.

 

Jurisdictions certified as disparate must submit a joint application for the aggregate of funds allocated to them, specifying the amount of the funds that are to be distributed to each of the units of local government and the purposes for which the funds will be used.  This includes an “Inter-local Agreement” among the affected recipients, to be sent to the Office of Justice Programs indicating who will serve as the applicant/fiscal agent for the joint funds.

 

The other constituent units involved in the joint application are:  County of San Bernardino, the Cities of Adelanto, Apple Valley, Barstow, Chino, Colton, Fontana, Hesperia, Highland, Montclair, Ontario, Rancho Cucamonga, Redlands, San Bernardino, Upland, and Victorville.

 

The City of Rialto Police Department plans to use the funding for a technology related project and equipment.

 

ENVIRONMENTAL IMPACT:

The proposed action does not meet the definition of a project as defined by Section 15378 California Environmental Quality Act (CEQA).  A “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and excludes the following:

 

1)                     Continuing administrative or maintenance activities, such as purchases for supplies, personnel-related actions, general policy and procedure making.

 

2)                     Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

 

GENERAL PLAN CONSISTENCY:

The City of Rialto has outlined key goals and objects relating to public safety. The purchase of this equipment is consistent with meeting these objectives.   

 

Goal 5-8: Provide effective and comprehensive policing services that meet the safety needs of Rialto.

 

LEGAL REVIEW:

The City Attorney has reviewed and approved this staff report, resolution, and agreement.

 

FINANCIAL IMPACT:

Operating Budget Impact

Staff recommends increasing fiscal year 2018/2019 estimated revenues in the Justice Assistance Grant Fund Account No. 213-400-6979-7540 by $28,457 and appropriating $28,457 in the expenditure Account No. 213-500-6979-2021 for fiscal year 2018/2019 for purchases allowed by the FY18 JAG Program.

RECOMMENDATION:

Staff recommends that the City Council:

 

                     Accept the FY18 Justice Assistance Grant (JAG) Grant funds in the amount of $28,457.

 

                     Approve the Inter-local Agreement with the County of San Bernardino.

 

                     Approve a Budget Resolution for fiscal year 2018/2019.
