FROM: Thomas J. Crowley, P.E., Utilities Manager
Title
Request City Council to Accept the Frisbie Park Sewer Lift Station Project, City Project No. 190501; Authorize Filing of the Notice of Completion; and Authorize Release of Retention to Kirtley Construction, Inc. (DBA TK Construction).
Body
BACKGROUND
The City is currently underway with providing improvements to portions of Frisbie Park which is located at 598 E. Easton Street. This 27.4-acre site was only partially developed. The park had two restroom buildings and a snack bar on two separate septic systems. The new park will include a third restroom building and an additional snack bar building. It was the desire of the City Council to convert the existing septic systems at the park and connect the new facilities being constructed to the City’s sewer collection system.
As a standalone project, Frisbie Park Sewer Lift Station project is an expansion of the existing sewer collection system and allows for the connection of Frisbie Park and the proposed Tentative Tract Map (TTM) to the sewer system. This project consisted of the construction of a sewer lift station that will accommodate the flows from the park and the TTM. Approximately 760 linear feet of 8” VCP sewer line in Easton Street will collect the flows from the park facilities to the sewer lift station, approximately 1,040 linear feet of a 8” VCP sewer line in Eucalyptus Avenue will collect the flows for the eleven lot TTM, and 1,310 linear feet of force main in Eucalyptus Avenue will connect the sewer lift station to the existing sewer collection system. In addition, the sewer lift station requires a backup generator powered by diesel in the event there is loss of power to the site.
The City Council/Rialto Utility Authority Board awarded a Construction Contract to Kirtley Construction, Inc. on September 10, 2019, in the amount of $1,000,576 to construct the Frisbie Park Sewer Lift Station. On that same date, the City Council/Rialto Utility Authority Board authorized issuance of a purchase order to Berg & Associates in the amount of $100,000 for on-call construction management and inspection services; and authorized the City Manager to approve contract changes in the not-to-exceed amount of $25,000.
ANALYSIS/DISCUSSION
On May 28, 2020, the Contractor satisfactorily completed the Frisbie Park Sewer Lift Station Project. The project successfully expanded the sewer collection system and connected restroom facilities at the Park to the sewer system. In addition, there is an eleven lot TTM that is being considered adjacent to the park that would also be tributary to the proposed sewer lift station.
To complete construction of the sewer lift station that serves the Park and TTM, three change orders were necessary. Change Order No. 1 was issued for materials and labor necessary to fill in a leach pit discovered during construction adjacent to the septic tank being decommissioned. Change Order No. 2 was issued for survey work necessary to relocate the gravity sewer main necessary to maintain a ten (10) foot separation from an existing water line. Change Order No. 3 was issued to add re-bar cages and account for the additional two feet depth required for the post footings for the fencing that surrounds the lift station. Slurry and striping work included in the original contract were deleted from the contract and is being added to the Frisbie Park Expansion Project. This deletion is being done to allow the roadway work to be done together and will result in a more attractive and cohesive appearance.
Staff conducted a final inspection and found the work to comply with the plans, specifications, and standards of the City of Rialto/Rialto Utility Authority. Upon acceptance by City Council/Rialto Utility Authority Board, staff will file a Notice of Completion for recordation at the County Recorder’s office. A copy of the Notice of Completion is included as Attachment 1.
Table 1 below summarizes the total construction costs for the project.

A copy of Contract Change Orders are included as Attachment 2.
This item was presented to the Water Subcommittee on May 28, 2020, who recommended presenting it to the full City Council/Rialto Utility Authority Board for approval. It should be noted that this item would have been scheduled for the May 19, 2020, meeting of Utilities Commission (UC); however, the UC meeting was canceled in compliance with COVID-19/Coronavirus social distancing guidelines as described in Governor Newsom’s Executive Order N-33-20.
ENVIRONMENTAL IMPACT
Construction of the Project is subject to state environmental review pursuant to the California Environmental Quality Act (CEQA). The City, acting as the lead agency pursuant to CEQA, prepared an Initial Study and a Mitigated Negative Declaration (MND) for the Project. The City approved the MND on March 20, 2019 and on March 21, 2019; a Notice of Determination was filed with the County Clerk.

LEGAL REVIEW
The City Attorney has reviewed and supports the staff report
FINANCIAL IMPACT
The Frisbie Park Sewer Lift Station project is an expansion of the existing sewer collection system and allows for the connection of Frisbie Park and the proposed Tentative Tract Map (TTM) to the sewer system. Sewer collection and treatment DIFs will be collected from the proposed 11 lot TTM once the project is finalized. There may be an opportunity to assess a portion of the construction costs related to the TTM as a condition of their project.
Operating Budget Impact
Any operating costs of the sewer lift station will be absorbed through the Concession Agreement.
Capital Improvement Budget Impact
The project budget, incurred expenditures, and other associated costs are identified in Table 2.

Table 2
The City is holding retention of $50,397.04 for Kirtley Construction, Inc. (DBA TK Construction), pending acceptance of the improvements and filing of the Notice of Completion with the County Recorder’s office.
The project included construction of a new sewer lift station; therefore, the Finance Department will add the value of this project to the City’s fixed asset system in compliance with the Government Accounting Standard Board (GASB) 34 Standards for Financial Reporting of Infrastructure Assets. The GASB 34 worksheet is included as Attachment 3.
Licensing
A business license is not required with the requested action.
