Request City Council Approve a Contract Services Agreement with Econo Fence, Inc. in the Amount of $88,705; and Approve the Third Amendment to the Professional Services Agreement with STK Architecture Inc. in the Amount of $57,015 Associated with Construction of Fire Station 205.

BACKGROUND

 

In November 2017 the City Council approved a Professional Services Agreement with STK Architecture, Inc., to provide professional architectural services related to the design of the new Fire Station 205.

 

On August 14, 2018, City Council awarded a construction contract to Pacific Hydrotech, Corporation in the amount of $3,646,800 for the Fire Station 205 Phase 1 Improvements, City Project No. 170203. The scope of the project included site improvements such as grading a 3 ½ acre site, all wet and dry utilities, CMU walls and metal fencing, A.C. paving, metal gates and an above ground fuel tank.  The Project included a 4-bay, pre-engineered Apparatus, one modular building for living quarters and a pad for a training tower.

 

On September 24, 2019, City Council awarded a construction contract to Robert Clapper Construction Services, Inc. in the amount of $3,147,000 for Fire Station 205 Phase 2 Improvements, City Project No. 190211. The Project included completion of the Fire Station 205 building.

 

ANALYSIS/DISCUSSION

Construction of both projects is substantially completed, pending resolution of punch list items and completion of limited work not identified in the original scope of the project, including:

 

                     Exterior Flood Lights - All required Flood Lights, per the Fire Department, have been installed, except for the light pole located north of Fire Station 205. The light pole has been ordered and we expect delivery on October 15, 2021.

 

                     Security Cameras - Cameras system from Alarmco has been approved by the Fire Department, and we expect installation by the middle of September 2021.

 

                     Station Access Doors/Security- Securitas has installed all needed components and hardware and are coordinating with Confire for IT Connectivity.

 

                     Installation of security fencing along the northern perimeter of the site.

 

 

Econo Fence Inc.

Staff obtained a proposal from Econo Fence, Inc., to install the new security fencing along the northerly perimeter. Econo Fence provided and installed the security fencing previously installed along the easterly perimeter of the site. Staff recommends the City Council approve a Contract Services Agreement with Econo Fence, Inc. in the amount $88,705 for installation of the security fencing along the northern perimeter of the Fire Station. A copy of the agreement with Econo Fence, Inc., and the Vendor’s Disclosure form are included as Attachments 1 & 2.

 

STK Architecture, Inc.

 

During construction of Fire Station 205, the City was required to expand the scope of services of the architect to provide construction phase services as the Owner’s Representative. These services have been required beyond the term of the agreement with STK Architecture as previously extended to ensure the remaining items associated with construction of Fire Station 205 were successfully resolved.

 

Staff recommends that the City Council approve a Third Amendment to the Professional Services Agreement (PSA) to STK Architecture Inc. in the amount of $57,015 extended construction phase services, for a total contract amount of $457,943. Services that have been provided by STK Architecture during the extended construction phase include:

 

                     Additional construction services for the installation of the 24” RCP pipe into the storm drain channel, coordinating permits, coordinating Leighton Group for compaction testing, and

                     On-site observation and conference meetings for construction observation meetings and reports.

 

The supplemental construction work requires continued construction management support for project close out.  A copy of the Third Amendment and Disclosure form are included as Attachments 3 & 4.

 

In addition, staff continues to work with the Fire Department staff on other items related to paint/cosmetics, electrical, security and perimeter, doors and access, HVAC, plumbing, and other items identified by staff.  Some of these items are under warranty and/or responsibility of contractors which are being coordinated accordingly.

 

There is sufficient budget remaining in the project to fund the proposed items.

 

ENVIRONMENTAL IMPACT

The City prepared an Initial Study and Mitigated Negative Declaration (IS/MND) for the Fire Station 205 project. The City circulated the Initial Study for public review and comment for a 20-day period, and the City received one comment letter. The Development Review Committee reviewed the Fire Station 205 project and approved a Mitigated Negative Declaration on December 6, 2017. On December 11, 2017, the City filed a Notice of Determination (NOD) with the County Clerk.

 

GENERAL PLAN CONSISTENCY

This action is consistent with the following City of Rialto Guiding Principle:

 

Our City government will lead by example, and will operate in an open, transparent and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Goal 3-6:                     Require that all developed areas within Rialto are adequately served with essential public services and infrastructure.

 

Policy 3-6.1:                     Coordinate all development proposals with other affected public entities to ensure the provision of adequate public facilities and infrastructure services.

 

Policy 3-6.3:                     Require an increasing level of public safety infrastructure and service capability ties to population increase and increasing service demand.

 

Goal 5-3:                     Increase the City’s fire protection capabilities and implement fire prevention regulations and standards that minimize potential fire hazards and fire losses.

 

Policy 5-3.1:                     Provide for fire personnel, equipment, and fire stations to have adequate and appropriate resources to meet the needs and serve all areas of Rialto.

 

Policy 5-3.6:                     Establish a fire station south of I-10 and improve fire coverage capabilities of this area.

 

LEGAL REVIEW

The City Attorney has reviewed and supports this staff report.

 

FINANCIAL IMPACT

Operating Budget Impact

Annual maintenance costs for Fire Station 205 will be included in future year Fire Department operating budgets.

 

Capital Improvement Budget Impact

Project Funds were previously budgeted in the Fire Development Fund 217 for Phase 1, and the Fire Development Fund 217 and the Facilities Development Fund 270 for Phase 2.

 

Award of the Contract Services Agreement with Econo Fence Inc. in the amount of $88,705, and Approval of the Third Amendment to the Professional Services Agreement with STK Architecture Inc. in the amount of $57,015 will be paid from the Facilities DIF Fund Account No. 270-500-2147-3001-190211-16 and Account No. 270-500-2147-3001-190211-23.

 

Licensing

A Business License application and payment of a Business License tax at the Professional Service rate in the amount of $154 will be paid by Econo Fence Inc. and $129 will be paid STK Architecture Inc.

 

RECOMMENDATION

Staff recommends that the City Council:

 

                     Approve a Contract Services Agreement with Econo Fence Inc. in the amount of $88,705 for the Installation of a Steel Fence at Fire Station 205;

                     Approve the Third Amendment to the Professional Services Agreement with STK Architecture, Inc. in the amount of $57,015 for Continued Construction Management Services, for a total Contract Amount Not-To-Exceed of $457,943; and

                     Authorize the City Manager to execute all documents.
