RECOMMENDATION
Staff requests that the City Council:
1. Adopt a Resolution approving the Public Improvement Agreement for public improvements along Lilac Avenue related to the Precise Plan of Design (PPD) 2022-0070 located on the west side of Lilac Avenue approximately 550 Feet North of Jurupa Avenue within the Light Manufacturing (M-1) Zone; and,
2. Authorize the City Manager or their designee to execute all related documents.
BACKGROUND
On October 11, 2023, the City of Rialto Planning Commission adopted a resolution approving Precise Plan of Design No. 2022-0070 allowing the development of a truck yard consisting of a 1,400 square foot office building, paving, landscaping, lighting, screen walls, and drainage improvements on 3.48 acres of land (Assessor’s Parcel Numbers 0258-102-52 and -53) with a 1,400 square foot office building, subject to the findings and conditions therein. The development is located on the west side of Lilac Avenue, approximately 550 feet north of Jurupa Avenue. A copy of the Planning Commission staff report is included as Attachment 1.
ANALYSIS/DISCUSSION
SFG ISF Bloomington Lilac, LLC (the “Developer”) requests that the City Council approve the Public Improvement Agreement (PIA) for the construction of certain public improvements along Lilac Avenue as required by the conditions of approval. The public improvements consist of, but are not limited to, the following: asphalt base, asphalt concrete, curb & gutter, sidewalk, streetlights, driveway approaches, landscaping & irrigation, undergrounding of overhead utilities, and street signing & striping.
The Developer has submitted an executed PIA and security to guarantee the completion of the public improvements. A copy of the PIA is included as Attachment 2. A copy of the Disclosure Statement is included as Attachment 3.
ENVIRONMENTAL IMPACT
Based on the findings presented at the Planning Commission on October 11, 2023, the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA). The project qualifies as a Class 32 exemption under CEQA Guidelines Section 15332 - In-Fill Development Projects - as the project is consistent with the Rialto General Plan and the Light Industrial (M-1) zoning designation, the project occurs on a site less than 5.0 acres in size that is substantially surrounded by development, the project site has no value as habitat for threatened or endangered species, the project will not result in any significant effects relating to traffic, noise, air quality, or water quality, and the project site can be adequately served by all required utilities and public services.
GENERAL PLAN CONSISTENCY
The project is consistent with the following goals of the Land Use Element of the Rialto General Plan:
Goal 2-19: Encourage neighborhood preservation, stabilization, and property maintenance.
Goal 2-21: Ensure high-quality planned developments in Rialto.
LEGAL REVIEW
The City Attorney’s Office has reviewed the Resolution and Public Improvement Agreement and approved them as to form.
FINANCIAL IMPACT
Operating Budget Impact
The completion of public improvements adds an estimated value of $102,672 to the City street system based on the Governmental Accounting Standards Board 34 (GASB34) for this specific project.
Capital Improvement Budget Impact
The proposed action will not affect the City’s Capital Improvement Budget.
Licensing
Before execution of any issued on-site or off-site Construction Permits, the Contractor secured a business license application and paid a Business License tax at the contractor's rate, as well as Administration and State fees for his contractors performing any improvements and shall renew accordingly.
