Request City Council to: (1) Adopt Resolution No. 7997 Amending the 2022-2023 Fiscal Year Budget; (2) Approve a Police Services Agreement Between Amazon.com, Inc. and the City of Rialto for the Period November 16, 2022 Through December 31, 2022, at a Fee not to Exceed $310,727.04, and (3) Authorize the City Manager to Execute All Documents.

BACKGROUND

The Rialto Police Department over the last several years has provided contract services to local business.  These services include uniformed presence and traffic control.

 

The Rialto Police Department works with the local business to develop a customized plan for services. These plans may vary from one business to the next, depending on the type of service requested as well as the goals of the business.

 

ANALYSIS/DISCUSSION

The Rialto Police Department has contracted with nonprofit organizations and businesses in the past offering services consistent with the needs and goals of the City.  Both Amazon distribution centers anticipate an influx of commercial truck traffic during the holiday season as Amazon’s shipping operations significantly increase. The influx of commercial traffic may create hazards on the roadways surrounding the Amazon warehouses. The traffic control provided by the Police Department ensures the safety of not only the citizens of Rialto, but the employees of Amazon. 

 

Amazon Distribution Centers-LGB7 (1660 N. Linden Avenue) and SBD1 (3388 S. Cactus Avenue) have requested the services of the Rialto Police Department to provide formalized traffic control during the holiday season.   The Term of this Agreement shall be from November 16, 2022, through December 31, 2022. Based on this Agreement, the City shall provide the following services (“Services”):

 

Amazon Distribution Center - SBD1 located at 3388 S. Cactus Avenue in the City of Rialto,

 

                     Two (2) sworn peace officers or sergeant assigned to the Traffic Division Motor Unit who will provide extra patrol and traffic enforcement during shift changes.

                     Subject to the availability of resources, the two (2) officers or sergeant will be in place for the duration of the shift starting November 16, 2022 to December 31, 2022 from 5:00 PM to 9:00 PM.

Amazon Distribution Center - LGB7 located at 1660 N. Linden Avenue in the City of Rialto,

                     Four (4) sworn peace officers, corporals, or sergeants to provide setup of barriers and cone patterns on November 22, 2022, from 7:00 AM to 11:00 AM.

 

                     The two (2) sworn peace officers, corporals, or sergeants will provide traffic control services during two (2) shifts, every day starting November 23, 2022, and concluding on December 26, 2022.  One shift will be from 4:00 AM to 8:00 AM, and the second shift will be from 4:00 PM to 8:00 PM.

 

                     Four (4) sworn peace officers, corporals, or sergeants to provide breakdown of barriers and cones patterns on December 27, 2022, from 07:00 Am to 11:00 AM.

 

Amazon.com, Inc. agrees to pay for the services at the fully burdened rate of the sworn police officer, corporal, or sergeant, which is equal to $329.16 per hour. Staff will invoice Amazon for the estimated fully burdened reimbursement costs for all services contemplated by this Agreement, not to exceed $310,727.04.

ENVIRONMENTAL IMPACT

The proposed action does not meet the definition of a project as defined by Section 15378 California Environmental Act (CEQA).  A “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and excludes the following:

 

1.                     Continuing administrative or maintenance activities, such as purchases for supplies, personnel-related actions, general policy and procedure making.

 

2.                      Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

 

GENERAL PLAN CONSISTENCY

The City of Rialto has outlined key goals and objectives relating to public safety.

 

Goal 5-8: Provide effective and comprehensive policing services that meet the safety needs of Rialto.

 

Policy 5-8.4: Initiate proactive crime suppression and prevention strategies throughout the community.

 

LEGAL REVIEW

The City Attorney has reviewed and supports this staff report and related contract.

 

FINANCIAL IMPACT

Operating Budget Impact

Approval of the agreement will increase estimated revenues in the amount of $310,727.04 to the General Fund Account No. 010-400-6294-7628, while increasing overtime expenditures in the amount of $108,885.75 in the General Fund Account No. 010-500-6294-1020.

 

Capital Improvement Budget Impact

This report does not impact the Capital Improvement Budget.

 

Licensing

This action does not trigger a requirement for a business license.

 

RECOMMENDATION

Staff recommends that the City Council:

 

(1)                     Adopt a Resolution amending the 2022-2023 fiscal year budget;

 

(2)                     Approve an agreement for traffic control services between Amazon.com, Inc. and the City of Rialto for the period November 15, 2022, through December 31, 2022, at a fee not to exceed amount of $310,727.04; and

 

(3)                     Authorize the City Manager to execute all documents.
