RECOMMENDATION

Staff recommends that the City Council:

1.                     Adopt a Resolution No. 8238, Accepting the SB 1383 Local Assistance Grant Program, FY 2022-23, for the City of Rialto in the amount of $274,747.

BACKGROUND

In September 2023, the Department of Resources Recycling and Recovery (CalRecycle) opened the SB 1383 Local Assistance Grant Program pursuant to Chapter 395, Statutes of 2016 for the 2022/2023 fiscal year.  The purpose of this noncompetitive grant is to provide funding to local jurisdictions to assist with implementing regulation requirements associated with SB 1383.  For this grant cycle, $90,000,000 was available, subject to funding availability; the base award for each eligible jurisdiction was $75,000.

On November 14, 2023, the City Council granted staff approval to submit a grant application for the SB 1383 Local Assistance Grant Program pursuant to Chapter 395, Statutes of 2016, that meets the $75,000 base award for each eligible applicant.

ANALYSIS/DISCUSSION

Staff submitted the application to CalRecycle on November 15, 2023, requesting funding in the amount of $101,789.91 to purchase a Finn Bark Blower to apply compost, bark, or cover mulch to the turf in parks, street medians, and other City facilities. The procurement of recycled organic products, compost, and/or mulch is a requirement of SB 1383. The City’s mandated annual procurement target is 8,205 tons of compost/mulch.

On February 26, 2024, The Department of Resources Recycling and Recovery (CalRecycle) approved awards for the SB 1383 Local Assistance Grant Program, FY 2022-23, to the City of Rialto in the amount of $274,747.   Funding awarded by CalRecycle exceeded the amount initially requested in the grant application submitted.  Table 1 below indicates how the awarded funds will be spent:

Table 1

All services or purchases listed in the table above are within the City Manager’s signature authority except for the Finn Bark Blower.  Staff is requesting the City Council authorize a Purchase Order with Clairemont Equipment for the purchase of an MBH6 Finn Bark Blower through the cooperative purchase program Sourcewell.

In 2011, the City of Rialto entered an Interlocal contract with Sourcewell to participate in its cooperative purchasing program. In 2022, the City of Rialto renewed the agreement with Sourcewell. Sourcewell is a “Government-to-Government” procurement service available nationwide. This cooperative purchasing program assists local governments in reducing costs by capitalizing on bulk purchasing power and pre-established competitive bids.  Pursuant to the provisions of the City’s Purchasing Ordinance, Section 2.48.210, “Cooperative Purchasing Programs,” the City Council may authorize the acquisition of the Bark Blower through a joint powers or other cooperative purchasing program.

ENVIRONMENTAL IMPACT

The proposed request is not a “Project” as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.
