BACKGROUND

The Rialto Family Health Services (RFHS) has been providing services to the City of Rialto and surrounding area since 2015, including the Back on Track Project which provides coaching and mentoring to adults with penal code violations through the process of expungement and the Veterans Assistance Program which aids Veterans and family members in obtaining benefits they qualify for.  RFHS has been a CDBG awardee for the past few years and was also an awardee of the Prop 47 Grant.

 

Since 2015 RFHS has used Room 504 office space at the Carl Johnson Center allocated to them with their hours of operation coinciding with the Rialto Community Center hours of operations, resulting in no incurred staff costs for the Parks, Recreation & Community Services Department. 

 

The last MOU between the City and RFHS was approved in August 2016 with any rental fees waived. 

 

ANALYSIS/DISCUSSION

The RFHS organization has for the past several years been allocated office space in Room 504 of Building 500 of the Carl Johnson Center to provide health and wellness programming for the community at large, however since November 2018 the organization has been operating on the City’s premises without an updated MOU.

 

The previous MOU between the City and the RFHS called for the City to agree to provide the 504 office space, ongoing maintenance and operations of the Rialto Community Center.  On August 23, 2016, the City Council adopted Resolution No. 6992 approving a Memorandum of Understanding (MOU) between the City and RFHS for the City to provide office space for the implementation of expungement Services of Criminal Records and Services for Veterans out of Rialto Community Center and waiving rental fees.

 

The terms of the Facility License Agreement includes an annual rental fee of $500. The initial term of 8 months will commence November through June 30, 2023, with the rental fee prorated to $300.

 

RFHS has requested waiver of the first rental fee of $300.

 

The term of the Agreement may be extended by the City Manager for two, one-year optional extensions. The term may also be terminated for convenience by both parties with 30 days notice.

 

ENVIRONMENTAL IMPACT

The requested action is not a “Project” as defined by the California Environmental Quality Act (CEQA).  Pursuant to Section 15378(a), a Project means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  According to Section 15378(b), a Project does not include:  (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

Operating Budget Impact

Revenue collected will total $500.00 annually.

 

Capital Improvement Budget Impact

There is no Capital Improvement Impact.

 

RECOMMENDATION

Staff recommends the City Council:

(1) Approve a Facility License Agreement between the City of Rialto and the Rialto Family Health Services for office space in room 504 at the Johnson Community Center for a Term of 8 Months with Two One-Year Extensions.

(2) Waive the First Term Payment of $300; and

(3) Authorize the City Manager to Execute All Documents
