Request City Council to: (1) Adopt Budget Resolution No. 8132 Amending the Continued 2022/2023 Fiscal Budget and Appropriating $196,200 from the Gas Tax Fund; (2) Award a Construction Contract to Superior Pavement Markings Inc. in the Amount of $319,123 for the Construction of the Class II Bike Lanes on Merrill Avenue and Riverside Avenue, Federal Project No. HSIP 5205-024, City Project No.170813, and (3) Authorize the Interim City Manager to Execute all Related Documents.

BACKGROUND
On July 31, 2015, staff submitted a grant application for the Highway Safety Improvement Program (HSIP) Cycle 7 from the Federal Statewide Transportation Improvement Plan (FSTIP) to improve safety for bicycle traffic along Merrill Avenue from the eastern City Limits to the western City limits and on South Riverside Avenue from Slover Avenue to Agua Mansa Road.
On August 22, 2017, the City Council accepted the HSIP Cycle 7 grant and amended the Capital Improvement Program to include this capital project.
On January 23, 2018, the City Council awarded a Professional Services Agreement with KOA Corporation for the Engineering Design of the Class II Bike Lanes Project.
On May 10, 2022, the City Council awarded a construction contract for the reconstruction of Riverside Avenue from I-10 to the southern City boundary. Staff has coordinated the completion of the Riverside Avenue reconstruction and final traffic striping to accommodate the planned bicycle lanes.
On January 10, 2023, the City Council authorized the release of Request for Bids (RFB) for the Construction of the Class II Bike Lanes Project.
ANALYSIS/DISCUSSION
On June 23, 2023, the City released RFB No. 23-027 Construction of the Class II Bike Lanes on Merrill Avenue and Riverside Avenue, Federal Project No. HSIP 5205-024, City Project No.170813, published the Notice Inviting Bids in the San Bernardino County Sun Newspaper and on the PlanetBids.com website.
On July 25, 2023, the City received one (1) bid from Superior Pavement Markings Inc.
A complete bid summary is included as Attachment 1. The engineer’s estimate was $319,123. Staff reviewed the bid and found Superior Pavement Markings Inc. to be properly licensed and qualified. Superior Pavement Markings Inc.’s Disclosure Statement, Contractor’s License, and DIR Verification documents are included as Attachment 2. Staff recommends that the City Council accept the bid received from Superior Pavement Markings Inc. as the lowest responsible and responsive bid. A construction contract with Superior Pavement Markings Inc. for the project is included as Attachment 3.
ENVIRONMENTAL IMPACT
On February 1, 2021, Caltrans, as the lead agency, pursuant to the National Environmental Policy Act (NEPA), made an environmental determination that this project qualifies for a Categorical Exclusion in accordance with 23 CFR 771.117(c), pursuant to activity(c)(3).
The City, as the lead agency pursuant to the California Environmental Quality Act (CEQA) determined this Project is Categorically Exempt from CEQA pursuant to Section 15301 “Existing Facilities”, pursuant to Class 1(c). A Notice of Exemption was filed on June 25, 2018, included as Attachment 4.
GENERAL PLAN CONSISTENCY
This action is consistent with Guiding Principle 3A in the General Plan:
Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.
Approval of this action also complies with the following City of Rialto General Plan Goals and Policies:
Goal 4-8: Establish and maintain a comprehensive system of pedestrian trails and bicycle routes that provide viable connections throughout the city.
Policy 4-8.3: Connect school facilities, parks, and other activity nodes within residential neighborhoods with bicycle trails on neighborhood streets.
LEGAL REVIEW
The City Attorney has reviewed and supports this staff report and Construction Contract.
FINANCIAL IMPACT
Operating Budget Impact
The proposed action will not affect the Operating Budget.
Capital Improvement Budget Impact
The project is currently funded by the federal HSIP grant in the Special Grant Project Fund Account No. 22234420-53001 in the amount of $158,120. A local match of $29,600 has been budgeted through the Measure I Fund Account No. 22014310-53001.
Staff recommends that an additional $196,200 be appropriated from the Gas Tax Fund Account, 22024317-53001-170813-23 to accommodate additional budget for the construction contract.

After adoption of the requested Budget Resolution, funds to appropriate for award of the construction contract with Superior Pavement Markings Inc. in the amount of $319,123 will be budgeted and available from the following two sources:
• Special Grant Project Fund Account No. 22234420-53001-170813-05 in the amount of $123,110; and
• Gas Tax Fund Account No. 22024317-53001-170813-23 in the amount of $196,013.
Licensing
A Business License tax at the Professional Service rate in the amount of $379 based on the construction amount of $319,123 will be assessed against the project and paid by interoffice transfer.
RECOMMENDATION
Staff recommends that the City Council:
1) Adopt Budget Resolution No. _____ Amending the Continued 2022/2023 and Fiscal Budget and Appropriating $196,200 from the Gas Tax Fund;
2) Award a Construction Contract to Superior Pavement Markings Inc. in the amount of $319,123 for the Class II Bike Lanes on Merrill Avenue and Riverside Avenue, Federal Project No. HSIP 5205-024, City Project No.170813; and
3) Authorize the Interim City Manager to Execute all Related Documents.
