RECOMMENDATION:

Staff requests that City Council:

 

1)                     Award a contract change order to CT&T, Concrete Paving Inc., in the amount of $248,595 for additional scope of work for the Frisbie Middle School Safe Route to School (SRTS) Improvements Project, City Project No. 240804;

2)                     Authorize a task order in the amount of $38,200 with Bureau Veritas North America pursuant to the City’s “on-call” agreement for construction management, inspection, and materials testing services; and

3)                     Authorize the City Manager or their designee to execute all related documents.

 

BACKGROUND:

On May 3, 2023, the San Bernardino County Transportation Authority (SBCTA) Board authorized the release of the Transportation Development Act (TDA) Article 3 Call for Projects for Bicycle and Pedestrian Facilities projects and Transit Access Improvement Projects.

 

On June 13, 2023, the City Council authorized Staff to submit applications through the TDA Article 3 Call for Projects with reference to the City’s School Safe Routes to School (SRTS) Plan, which identifies issues and opportunities related to suggested routes for walking and bicycling. Using the SRTS Plan, staff recommended pursuing improvements at Frisbie Middle School and Bemis Elementary because these locations are designated as high-priority segments in the SRTS plan.

 

On October 4, 2023, the SBCTA Board of Directors approved projects submitted for the TDA Article 3 Call for Projects, including the Frisbie Middle School SRTS Improvements Project in the amount of $1,095,090.75, with a local match of $589,664.25.

 

On June 11, 2024, the City Council authorized a purchase order to Michael Baker International in the amount of $340,975 for the design of the project. Staff coordinated with Michael Baker International to prepare the construction plans, specifications, and estimates per their On-Call Professional Civil Engineering Services Agreement with the City. The design portion for this project was completed in August 2025.

 

On February 10, 2026, the City Council awarded a construction contract to CT&T Concrete Paving, Inc. (CT&T) in the amount of $650,256 for the construction of the project and authorized a task order in the amount of $79,888 with SPECS Engineering Group (SPECS), pursuant to the City’s “on-call” agreement for construction management, inspection, and materials testing services for the Frisbie Middle School Safe Routes to School Improvements Project Phase I, City Project No. 240804.

 

ANALYSIS/DISCUSSION:

The Frisbie Middle School Safe Routes to School Project includes the construction of curb ramps, sidewalks, driveways, parkway improvements, and signing and striping along the areas surrounding Frisbie Middle School.

 

During Phase I of the project, City staff reevaluated the existing conditions within and surrounding the neighborhood and determined that additional improvements are necessary to address existing deficiencies and meet current ADA requirements. The proposed improvements were not included in the original Phase I construction plans and specifications. The City has  $364,946.75 remaining in SBCTA grant funding available for eligible improvements that can be utilized for this additional work. The proposed improvements are located within a 2-mile radius of the project area. Incorporating this work into the current construction contract will allow the City to address these necessary ADA and accessibility improvements in a timely manner while maximizing the use of available grant funding and avoiding the potential loss or reversion of remaining SBCTA funds. Completing the work as part of the current contract will also improve pedestrian accessibility and safety and minimize the additional costs, coordination, and potential delays associated with completing the improvements under a separate future contract.

 

To address these needs and ensure delivery of an acceptable final product, staff requested that the contractor provide a proposal for the additional work associated with the replacement of concrete sidewalks and ADA ramps that were not included in the original contract.  Incorporating this work in the form of Contract Change Order No. 1 in the amount of $248,595 into the current construction contract will help avoid potential delays, improve student safety, and minimize future costs associated with completing the work separately.  Table 1 below includes the additional items that have been identified and their associated costs:

A copy of Contract Change Order No. 1 is included as Attachment 1.  The associated justification memo is included as Attachment 2.  A copy of CT&T’s change order proposal is included as Attachment 3.  An Overhead Exhibit of the project locations as Attachment 4.

 

Construction Management, Inspection, and Materials Testing Services

Staff requested a cost proposal from SPECS for the additional work.  SPECS declined to provide a proposal.  Staff requested proposals from Onward Engineering and Bureau Veritas North America for the additional on-call construction management, inspection, and materials testing services for this project.  Based on a review of these proposals, staff recommends approval of the proposal provided by Bureau Veritas North America.  Bureau Veritas North America has experience overseeing projects of this magnitude similar in scope to the Project.  A copy of their proposal is included as Attachment 5.  Bureau Veritas North America has provided a fee proposal of $38,200 to provide the required construction phase services through the duration of the project.  A copy of Bureau Veritas North America’s Disclosure Statement is included in Attachment 6Table 2 below provides the proposal amounts received from each firm:

ENVIRONMENTAL IMPACT:

Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act (CEQA).  The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment, and which are exempt from the provisions of CEQA.  In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment and are declared to be categorically exempt from the requirement for the preparation of environmental documents.  In accordance with Section 15301, “Existing Facilities,” Class 1 projects consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities; therefore, the Frisbie Middle School Safe Routes to School (SRTS) Project is considered categorically exempt from CEQA, and Notice of Exemptions will be prepared and filed with the San Bernardino County Clerk. 

 

GENERAL PLAN CONSISTENCY:

This action is consistent with Guiding Principle 3 in the General Plan:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

The City of Rialto has also outlined key Goals and Objectives through which the City looks to minimize congestion on the local road network, create opportunities and incentives for people to avoid use of their cars for short trips, maintain a circulation system that supports local businesses’ needs.  These efforts will contribute to reductions in greenhouse gas emissions pursuant to State mandates.

 

Goal 4-4:                     Protect school children and others from traffic hazards around schools.

 

Goal 4-8:                     Establish and maintain a comprehensive system of pedestrian trails and bicycle routes that provide viable connections throughout the City.

 

Goal 4-9:                     Promote walking.

 

Policy 4-9.1:                     Install sidewalks where they are missing and make improvements to existing sidewalks for accessibility purposes.  Priority should be given to needed sidewalk improvement near schools and activity centers.  Provide wider sidewalks in areas with higher pedestrian volumes.

 

Policy 4-9.3:                     Provide pedestrian-friendly and safety improvements, such as crosswalks and pedestrian signals, in all pedestrian activity areas.

 

LEGAL REVIEW:

The City Attorney’s Office has reviewed the contract change order and approved it as to form.

 

FINANCIAL IMPACT:

Operating Budget Impact:

The proposed action will not affect the Operating Budget.

 

Capital Improvement Budget Impact:

Budget for the Frisbie Safe Routes to School Project was programmed in the TDA Fund Account No. 22047326-53001-240804 in the amount of $1,095,090.75, with a local match of $589,664.25 from the Measure I Fund Account No. 22014300-53001-240804.  This sums to a total project budget of $1,684,755.  The current remaining SBCTA grant funding available for the project is $364,946.75.  The current action appropriates previously authorized funds to ensure continued progress on the project.  No additional funding beyond what has already been approved is required at this time.

 

If approved, Contract Change Order No. 1 of the construction contract with CT&T will be funded by the TDA Fund Account No. 22047326-53001-240804-05, in the amount of $248,595.  The task order with Bureau Veritas North America for construction management, inspection, and materials testing services will be funded by the TDA Fund Account No. 22047326-53001-240804-16 in the amount of $38,200. The total change order projected cost is $286,795.
