Title
Request that the City Council to Adopt Resolution No. 7989 Amending Resolution No. 7911 Related to the General Fund State Allocation Grant Funds for the Rialto Unified School District International Healing Garden Project to Program the Use of Funds for Construction Costs.

BACKGROUND
On April 12, 2022, the City Council approved a Fiduciary Agent Agreement to facilitate the state’s allocation of $1,000,000 to the Rialto Unified School District (RUSD) for development of their International Healing Garden Project. A copy of the staff report is included as Attachment 1. On June 14, 2022, the City Council adopted Resolution No. 7911 accepting the State’s General Fund grant funds on behalf of the Rialto Unified School District (RUSD) International Healing Garden Project with the use of the funds. Based on the initial direction from RUSD staff, the use of funds were designated for project planning (design) purposes only. Resolution No. 7911 is included as Attachment 2.
ANALYSIS/DISCUSSION
RUSD has determined to reprogram the use of its State General Fund grant funds for construction purposes rather than planning (design) purposes. The state requires the City as RUSD’s fiduciary agent to adopt a revised Resolution identifying the use of funds for construction purposes.
Staff recommends the City Council adopt the attached Resolution for this purpose.
ENVIRONMENTAL IMPACT
The proposed actions do not constitute a “project” as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(b), a project does not include organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.
GENERAL PLAN CONSISTENCY
This action is consistent with Guiding Principle 3A of the General Plan:
Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.
LEGAL REVIEW
The City Attorney reviewed and recommended approval of this staff report and resolution.
FINANCIAL IMPACT
Operating Budget Impact
The City will receive the state allocation of $1,000,000 that is specifically allocated for the purposes of the RUSD’s International Healing Outdoor Facility. RUSD will incur eligible expenses in the construction of the project and submit invoices to the City for reimbursement against funds the City has received from the state’s $1,000,000 allocation. There will be no direct fiscal impact to the City in this agreement, and the City will incur no costs related to RUSD’s project.
Capital Improvement Budget Impact
This action will have no impact on the current capital improvement budget.

Staff Request that the City Council Adopt Resolution No.7989 Amending Resolution No. 7911 Related to the General Fund State Allocation Grant Funds for the Rialto Unified School District International Healing Garden Project to Program the Use of Funds for Construction Costs.
