RECOMMENDATION

Staff recommends that the City Council/Rialto Utility Authority:

1)                     Adopt resolutions approving an Extraterritorial Wastewater Service Agreement with   Cedar Village Mobile Home Park, for the property located at 10701 Cedar Avenue, Bloomington, Assessor’s Parcel Numbers 0257-041-12 and 0257-041-23; and

2)                     Authorize the City Manager or their designee to execute all documents.

 

BACKGROUND

Cedar Village Mobile Home Park partners (Owner) own the property at 10701 Cedar Avenue, Bloomington, CA. This property, totaling 239 dwelling units, is located on the northeast corner of Cedar Avenue and Santa Ana Avenue. The Assessor’s Parcel Numbers are 0257-041-12 and 0257-041-23.

 

The City of Rialto owns, operates, and maintains the local public sanitary sewer system, which includes a wastewater collection system and treatment plant that serve most properties within the City limits and some areas of Bloomington. The subject property is not connected to any other sewer system, and the property owner has requested to connect to the Rialto wastewater system and has the option of connecting from Santa Ana Avenue or Larch Avenue.

 

This item was presented to the Water Subcommittee on July 24, 2025, and to the Cable Advisory and Utilities Commission on January 20, 2026. The Commissioners' recommendation was to present the request to the City Council/Rialto Utility Authority Board for formal consideration and approval of the Extraterritorial Wastewater Service Agreement with Cedar Village Mobile Home Park partners.

 

ANALYSIS/DISCUSSION

Cedar Village Mobile Home Park is currently on a septic system, and the property owner would like to connect to the City’s sewer system. A city-owned sewer line exists within Santa Ana Avenue and Larch Avenue. The property owner has contracted with a licensed contractor to construct a sewer lateral per City Standards to either of these existing sewer lines.

 

In order to connect to the City’s sewer system, the owner will be responsible for the design and construction of a sewer line at their expense. This includes, but is not limited to, ensuring the work complies with current Building and Plumbing Codes, obtaining all required permits and inspections from the City and County of San Bernardino, and making all repairs to the infrastructure damaged during connection to existing sewer lines.

 

In addition to the new sewer line, the Owner will owe the City development impact fees for the sewage treatment and collection systems at a rate equal to one point three (1.3) times the current sewage rate or charges. Rialto sewage treatment fees (for treatment of the wastewater at the treatment plant) vary.

 

Staff has prepared an Extraterritorial Wastewater Service Agreement to facilitate approval of the proposed service connection. The agreement describes the duties and responsibilities of the City of Rialto and the property owners. The proposed Extraterritorial Agreement, Sewer Improvement Plan, Site Map, Disclosure form, and resolutions are included as Attachments 1 - 6, respectively.

 

ENVIRONMENTAL IMPACT

The request is not a “Project” as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  The proposed agreements to connect the properties to the City’s sanitary sewer system will not result in a direct or indirect physical change in the environment because the system has sufficient capacity and, as such, the action is not a “Project” as defined under CEQA.

 

GENERAL PLAN CONSISTENCY

This action is consistent with the City of Rialto's General Plan Guiding Principle 3: Rialto's Economic Environment is Healthy and Diverse. “Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.” 

 

Approval of this action also complies with the City of Rialto General Plan Goals and Policies:

 

Goal 3-9:                     Upgrade and maintain an improved wastewater system with adequate plant efficiency and capacity to protect the health and safety of all Rialto residents, businesses, and institutions.

 

Policy 3-9.1:                     Require that all new development or expansion of existing facilities bear the cost of expanding the wastewater disposal system to handle the increased loads that they are expected to generate.

 

LEGAL REVIEW

The City Attorney's Office has reviewed the agreement and approved it as to form.

 

FINANCIAL IMPACTS

In order to connect to the City’s Wastewater system, the property owner will be required to make a one-time Development Impact Fee payment at the Extraterritorial Rate of 1.3 times the standard rate. The required connection fees are determined by the planned use of the facility and are estimated at $798,253.55 for both Wastewater Collection and Treatment fees. The calculations are shown in Table 1 below.

Operating Budget Impact

Rialto Water Services will bill the property owner at the subject property at 1.3 times the standard applicable monthly sewer rate, and the Utility Authority will absorb the operating costs to serve the property, within the Concession Agreement.

Capital Improvement Budget Impact

The requested action is expected to increase the Sewer Treatment Fund by $560,630.19 and the Sewer Collection Fund by $237,623.36 to be used on Development Impact Fee eligible projects.

 

Licensing

This action does not require a business license.
