RECOMMENDATION

Staff recommends that City Council:

 

1)                     Adopt a resolution approving Parcel Map 20867 for the subdivision of one parcel of land located at the southwest corner of Alder Avenue and Sierra Lakes Parkway within the Freeway Incubator (FI) land use district of the Renaissance Specific Plan into two new parcels of land - Parcel 1 (11.63 acres) and Parcel 2 (1.58 acres); and

2)                     Authorize the City Manager or their designee to execute all related documents.

 

BACKGROUND

On June 18, 2025, the City of Rialto Planning Commission conditionally approved Tentative Parcel Map (TPM) No. 2024-0003, which has been assigned TPM No. 20867 by the San Bernardino County Recorder’s Office.  A copy of the Planning Commission staff report is included as Attachment 1.  TPM No. 20867 shows the subdivision of one parcel of land located at the southwest corner of Alder Avenue and Sierra Lakes Parkway into two new parcels of land - Parcel 1 (11.63 acres) and Parcel 2 (1.58 acres).

 

ANALYSIS/DISCUSSION

Pilot Travel Centers, LLC (the “Subdivider”) requests that the City Council approve Parcel Map 20867 to subdivide one parcel of land (APN: 1119-241-28) located at the southwest corner of Alder Avenue and Sierra Lakes Parkway within the FI land use district of the Renaissance Specific Plan into two new parcels of land - Parcel 1 (11.63 acres) and Parcel 2 (1.58 acres).  All necessary public improvements exist along the parcels’ frontage.  A copy of Parcel Map 20867 is included as Attachment 2.  A copy of the Disclosure Statement is included in Attachment 3.

 

The City Engineer has determined that the conditions of approval associated with TPM 20867 have been satisfied, Parcel Map 20867 is in substantial conformance with TPM 20867, and Parcel Map 20867 is ready for City Council approval.

 

Approval of a Parcel Map is a ministerial action, and the City Council cannot condition its approval of the Parcel Map and cannot impose new conditions on the project that were not previously identified at the time the TPM was approved.

 

ENVIRONMENTAL IMPACT

The project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA).  The project qualifies as a Class 15 exemption under CEQA Guidelines, Section 15315 - Minor Land Divisions.  Section 15315 allows for allows for exemption of a project consisting of the division of property in an urbanized area zoned for residential, commercial, or industrial uses into four or fewer parcels when the division is in conformance with the General Plan and zoning, no variances or exceptions are required, all services and access to the involved parcels to local standards are available, the parcel was not involved in a division of a larger parcel within the previous two years, and the parcel does not have an average slope greater than 20 percent.  This project proposes the subdivision of one commercial parcel into two commercial parcels and meets all other criteria, thereby qualifying it for a Class 15 exemption.

 

GENERAL PLAN CONSISTENCY

The project is consistent with the following goals of the Land Use Element of the Rialto General Plan:

 

Goal 2-21:                     Ensure high-quality planned developments in Rialto.

 

LEGAL REVIEW

The City Attorney’s Office has reviewed the resolution and approved it as to form.

Operating Budget Impact

The proposed action will not affect the City’s Operating Budget.

 

Capital Improvement Budget Impact

The proposed action will not affect the City’s Capital Improvement Budget.

 

Licensing

Before execution of any issued On-Site or Off-Site Construction Permits, the Subdivider secured a business license application and paid a Business License tax at the Contractors rate, as well as Administration and State fees for his contractors performing any improvements and shall renew accordingly.
