Request City Council to (1) Award a Construction Contract to C-Works Engineering, Inc. in the amount of $153,722 for the CDBG Curb, Gutter, and Sidewalk Improvement Project, City Project No. CB1805 and (2) Authorize a Purchase Order with Willdan Engineering in the Amount of $38,000 for Construction Management and Inspection Services for the Project.

BACKGROUND:

The Public Works Department maintains a list of deteriorated and damaged concrete surface infrastructure throughout the City.  Items listed include curbs, gutters, sidewalks, cross-gutters, curb ramps, and driveway approaches.  The City periodically updates the list based upon staff initiated surveys of damaged facilities and reports from the community.

 

The 2017/18 fiscal year budget appropriated $153,780 from the Community Development Block Grant Fund for the CDBG Curb, Gutter, and Sidewalk Improvement Project.  Based on this funding, staff compiled a list of locations with damaged concrete improvements, including missing or substandard curb ramps located in CDBG eligible neighborhoods.  The CDBG project location map and construction list are included as Attachment 1.

 

On February 26, 2019, the City Council authorized release of Request for Bid No. 19-033 for the CDBG Curb, Gutter, and Sidewalk Improvement Project, City Project No. CB1805.

 

ANALYSIS/DISCUSSION:

On February 28, 2019, the City released RFB No. 19-033 for the CDBG Curb, Gutter, and Sidewalk Improvement Project, City Project No. CB1805, and published the Notice Inviting Bids in the San Bernardino County Sun; on the City of Rialto website, and on the PlanetBids.com website.

 

On April 4, 2019, the City received three (3) bids, tabulated in Table 1 below:

A full bid summary is included as Attachment 2.  The engineer’s estimate was $135,000 to $150,000.  The lowest responsible and responsive bid was $153,722 submitted by C-Works Engineering of San Bernardino, CA.  Staff reviewed the bid and found C-Works Engineering to be properly licensed and qualified.  C-Works Engineering’s Disclosure, Contractor’s License, and DIR Registration documents are included as Attachment 3.  Staff recommends that the City Council accept the bid received from C-Works Engineering as the lowest responsible and responsive bid.  A construction contract with C-Works Engineering for the project is included as Attachment 4.

 

The City of Rialto CDBG grant administrator, LDM Associates, Inc., reviewed all bids for CDBG compliance, and provided the Section 3 Bid Evaluation Memorandum included as Attachment 5.

 

Additionally, staff negotiated the scope and fee with Willdan Engineering for construction management and inspection services for the proposed project.  These services will be provided through the On-call Construction Management/Program Management professional services agreement with Willdan Engineering.  The number of working days associated with the construction management and inspection services for the proposed project is specified at 30 working days.  The Willdan proposal reflecting the negotiated scope and fee is included as Attachment 6.

 

ENVIRONMENTAL IMPACT:

Section 21084 of the California Public Resources Code requires that the guidelines for implementation of the California Environmental Quality Act (CEQA) include a list of classes of projects that have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA.  In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared categorically exempt from the requirement for the preparation of environmental documents.  In accordance with 14 CCR Section 15301 “Existing Facilities”, Class 1 projects consist of the repair, maintenance, or minor alteration of existing highways and streets, sidewalks, gutters, and similar facilities.  As a repair project of existing public facilities, the CDBG Curb, Gutter, and Sidewalk Improvement Project, City Project No. CB1805 is considered categorically exempt from CEQA.  Staff has prepared and filed a Notice of Exemption for the project, included as Attachment 7.

 

GENERAL PLAN CONSISTENCY:

This action is consistent with Guiding Principle 3A in the General Plan:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Approval of this action also complies with the City of Rialto General Plan Goal and Policies:

 

Goal 4-9:                     Promote Walking

 

Policy 4-9.1:                      Install sidewalks where they are missing, and make improvements to existing sidewalks for accessibility purposes. Priority should be given to needed sidewalk improvement near schools and activity centers. Provide wider sidewalks in areas with higher pedestrian volumes.

 

Policy 4-9.2:                      Require sidewalks and parkways on all streets in new development.

 

Policy 4-9.3:                      Provide pedestrian-friendly and safety improvements, such as crosswalks and pedestrian signals, in all pedestrian activity areas.

 

LEGAL REVIEW:

The City Attorney has reviewed and approved the staff report and construction contract.

 

FINANCIAL IMPACT:

Operating Budget Impact

The proposed action will not affect the Operating Budget.

 

Capital Improvement Budget Impact

The Construction Contract with C-Works Engineering for $153,722 will be funded from the CDBG Capital Fund Account 234-500-1856-3001-CB1805-05 for $151,320 and the Gas Tax Fund Account 202-500-4317-3001-180806-05 for $2,402.

 

The purchase order with Willdan Engineering in the amount of $38,000 for on-call construction management and inspection services will be charged to the Gas Tax Fund Account 202-500-4317-3001-180806-16.

 

Licensing

A Business License Tax at the Professional Services rate in the amount of $229.00 based on the construction amount of $153,722 will be assessed against the project and paid by interoffice transfer.

 

A Business License tax at the Professional Services rate in the amount of $104 will be paid by Willdan Engineering prior to execution of the Purchase Order.

 

RECOMMENDATION:

Staff recommends that the City Council:

 

                     Award a Construction Contract to C-Works Engineering, Inc. in the amount of $153,722 for the CDBG Curb, Gutter, and Sidewalk Improvement Project, City Project No. CB1805.

                     Authorize a Purchase Order with Willdan Engineering in the amount of $38,000 for Construction Management and Inspection Services for the Project.
