Staff requests that City Council:
1) Award a construction contract to Zeco, Inc., in the amount of $343,165 for Fergusson Park Resurfacing, City Project No. 25043; and
2) Authorize the City Manager or their designee to execute all related documents.
BACKGROUND
The athletic courts at Fergusson Park have served as a recreational amenity for residents and patrons of all ages. Consistent daily use, combined with weathering, has resulted in significant fading, surface wear, cracking, and uneven friction conditions. The current surface conditions directly affect participant safety, user comfort, and park aesthetics. Resurfacing the courts is needed to restore surface friction, improve traction, and eliminate inconsistencies that can contribute to injuries, slips, trips, and falls. Properly surfaced courts also reduce maintenance costs for labor and patching and increase court longevity. It is anticipated that fresh court surfacing with updated striping, colors, and surface treatments will encourage residents to actively participate in outdoor recreation, similar to the recent resurfacing at Rialto City Park.
Overall, the project will enhance the Park’s identity, increase resident use, improve public safety, and ensure Fergusson Park continues to serve the community as a vibrant, well-maintained public asset.
On September 9, 2025, the City Council approved a Funding Agreement with the County of San Bernardino and appropriated $120,000 to the Fergusson Park Resurfacing Project, with a local match of $100,000.
ANALYSIS/DISCUSSION
The project generally consists of resurfacing one basketball court, one half basketball court, and the conversion of two existing tennis courts into one tennis court and four pickleball courts at Fergusson Park, including the installation of associated appurtenances. The proposed courts will be vibrant, intentional, and professional, fostering an inviting environment that encourages the community to come together, play together, and stay active together.
On August 14, 2025, the City released RFB No. 25-043 for the Fergusson Park Resurfacing, City Project No. 25043, and published the Notice Inviting Bids on the PlanetBids.com website. On September 16, 2025, the City received two (2) bids as follows:

A complete bid summary is included as Attachment 1. The engineer’s estimate was $200,000. The bid bond submitted by Custom Courts, Inc. was invalid. As such, the bid submitted by Custom Courts, Inc. was considered nonresponsive to the contract documents. On September 18, 2025, Custom Courts Inc. was provided with a formal letter communicating the submission of an invalid bid bond. There was no protest from Custom Courts, Inc. in deeming their bid submission to be invalid. The lowest responsible and responsive bid was $343,165 submitted by Zeco Inc. Staff reviewed the bid and found Zeco Inc. to be properly licensed and qualified. Zeco Inc.’s Disclosure Statement, Contractor’s License, and DIR verification documents are included as Attachment 2. Staff recommends that the City Council accept the bid received from Zeco Inc. as the lowest responsible and responsive bid. A construction contract with Zeco Inc. for the project is included as Attachment 3.
ENVIRONMENTAL IMPACT
Section 21084 of the California Public Resources Code requires that the guidelines for implementation of the California Environmental Quality (CEQA) include a list of classes of projects that have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment and are declared categorically exempt from the requirement for the preparation of environmental documents. In accordance with 14 CCR Section 15301 “Existing Facilities”, Class 1 projects consist of the repair, maintenance, or minor alteration of existing structures and facilities; therefore, Fergusson Park Resurfacing, City Project No. 25043, is considered categorically exempt from CEQA. Staff has prepared and will file a Notice of Exemption for the project.
GENERAL PLAN CONSISTENCY
This action is consistent with Guiding Principle 3 in the General Plan:
Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.
Approval of this action also complies with the following City of Rialto General Plan Goals and Policies:
Goal 3-6: Require that all developed areas within Rialto are adequately served with essential public services and infrastructure.
LEGAL REVIEW
The City Attorney’s Office has reviewed the resolution and construction contract and approved them as to form.
FINANCIAL IMPACT
Operating Budget Impact
The proposed action will not affect the Operating Budget.
Capital Improvement Budget Impact
The project is currently being funded by the Community Services Grant Fund, account number 22488813-53001-05, in the amount of $120,000, and the Capital Project Fund, account number 33007304-53001-23, in the amount of $100,000. The combined total project budget is $220,000.
The Birdsall Park is anticipated to be completed under budget. The estimated savings from this project are sufficient to allocate the necessary $125,000 to the Fergusson Park Resurfacing project. Staff recommends allocating the unspent funds from this project in the total amount of $125,000 to the Fergusson Park Resurfacing project in the Capital Projects Fund, Account No. 33007304-53001. This reallocation will increase the total project budget to $345,000.
Upon approval, the construction contract with Zeco Inc. will be funded from the Community Services Grant Fund, account number 22488813-53001-05, and the Capital Project Fund, account number 33007304-53001-23, in the amount of $343,165.
Licensing
Zeco Inc. will pay a Business License Tax prior to commencing the services for this project.
