Body

RECOMMENDATION

Staff recommends that City Council:

1)                     Adopt Proposed Resolution No. 8284 Approving Parcel Map 20905 for the subdivision of one 1) parcel into two 2) parcels of land to facilitate the development of the lots; and

2)                     Delegate Authority to the City Manager or their designee to Execute all Related Documents.

BACKGROUND

On February 7, 2024, the City of Rialto Planning Commission conditionally approved Tentative Parcel Map (TPM) No. 2023-0002, which had been assigned TPM No. 20506 by the map preparer. A copy of the Planning Commission staff report is included as Attachment 1.  Since the Planning Commission's approval, an error was discovered in the numbering for TPM 20506.  The correct numbering is TPM 20905 which has been issued by the County of San Bernardino and verified by staff.  TPM No. 20905 shows the subdivision of one (1) parcel of land (APN 0128-011-32) located at the northeast corner of North Linden Avenue and West Foothill Boulevard into two (2) parcels.  The proposed parcels are in the Commercial-Pedestrian (C-P) zone.  The project site contains 2.17 acres of land.

ANALYSIS/DISCUSSION

1795 University Avenue, LLC (the “Subdivider”) requests that the City Council approve Parcel Map 20905 to subdivide one (1) parcel of land (APN 0128-011-32), located at the northeast corner of North Linden Avenue and West Foothill Boulevard into two (2) parcels.  A copy of Parcel Map 20905 is included as Attachment 2.  The surrounding public streets are complete with minor improvements that are required of this subdivision.  The project is required to construct, but is not limited to, public improvements such as pavement restoration, sewer laterals, water laterals, landscape & irrigation, streetlights, and driveway approaches.  The Subdivider has submitted a Subdivision Improvement Agreement to guarantee completion of the remaining public improvements.  A copy of the Subdivision Improvement Agreement is included in Attachment 3.  A copy of the Disclosure Statement is included in Attachment 4.

The City Engineer has determined that the conditions of approval associated with Tentative Parcel Map 20905 have been satisfied, that Parcel Map 20905 is in substantial conformance with Tentative Parcel Map 20905, and that Parcel Map 20905 is ready for City Council approval.

Approval of a Parcel Map is a ministerial action, and the City Council cannot condition its approval of the Parcel Map and cannot impose new conditions on the project that were not previously identified at the time the Tentative Parcel Map was approved.

ENVIRONMENTAL IMPACT

The project is exempt under California Environmental Quality Act (CEQA) Section 15315, Minor Land Subdivision.

GENERAL PLAN CONSISTENCY

The project is consistent with the following goals of the Land Use Element of the Rialto General Plan:

Goal 2-19:                     Encourage neighborhood preservation, stabilization, and property maintenance.

Goal 2-21:                     Ensure high-quality planned developments in Rialto.
