Request City Council to: (1) Adopt Resolution No. 8394 Approving Tract Map 20685 for the Subdivision of One Parcel of Land Located Approximately 620 Feet South of Merrill Avenue at the end of Althea Avenue within the Single Family Residential (R-1C) Zone into 20 Single-Family Lots; and (2) Authorize the City Manager or Their Designee to Execute all Related Documents.

RECOMMENDATION

Staff recommends that City Council:

 

1)                     Adopt a resolution approving Tract Map 20685 for the subdivision of one parcel of land located approximately 620 feet south of Merrill Avenue at the end of Althea Avenue within the Single Family Residential (R-1C) Zone into 20 single-family lots; and

2)                     Authorize the City Manager or their designee to execute all related documents.

 

BACKGROUND

On October 16, 2024, the City of Rialto Planning Commission conditionally approved Tentative Tract Map (TTM) No. 2023-0002, which had been assigned TTM No. 20685 by the San Bernardino County Recorder’s Office.  A copy of the Planning Commission staff report is included as Attachment 1.  TTM No. 20685 shows the subdivision of approximately 2.6 acres of vacant land, Assessor’s Parcel Number (APN) 0131-141-71, located approximately 620 feet south of Merrill Avenue at the end of Althea Avenue within the Single Family Residential (R-1C) Zone, into 20 single-family lots. 

 

ANALYSIS/DISCUSSION

ADC Rialto BFR, LLC (the “Subdivider”) requests that the City Council approve Tract Map 20685 to subdivide one (1) parcel of land (APN: 0131-141-71) located approximately 620 feet south of Merrill Avenue at the end of Althea Avenue within the Single Family Residential (R-1C) Zone into Twenty (20) Single-Family Lots.  A copy of Tract Map 20685 is included as Attachment 2.  The surrounding public streets are complete with minor improvements that are required of this subdivision.  The project is required to construct, but is not limited to, public improvements such as pavement restoration, on-site public sewer main, on-site public water main, and off-site drainage improvements.  The Subdivider has submitted a Subdivision Improvement Agreement to guarantee completion of the remaining public improvements.  A copy of the Subdivision Improvement Agreement is included in Attachment 3.  A copy of the Disclosure Statement is included in Attachment 4.

 

The City Engineer has determined that the conditions of approval required for final map recordation have been satisfied, Tract Map 20685 is in substantial conformance with TTM 20685, and that Tract Map 20685 is ready for City Council approval.

 

Approval of a Tract Map is a ministerial action, and the City Council cannot condition its approval of the Tract Map or impose new conditions on the project that were not previously identified at the time the TTM was approved.

 

ENVIRONMENTAL IMPACT

The project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15332 (Class 32), In-Fill Development Projects. The exemption pertains to projects less than 5.0 acres in size and surrounded by existing development.

 

GENERAL PLAN CONSISTENCY

The project is consistent with the following goals of the Land Use Element of the Rialto General Plan:

 

Goal 2-19:                     Encourage neighborhood preservation, stabilization, and property maintenance.

 

Goal 2-21:                     Ensure high-quality planned developments in Rialto.

 

LEGAL REVIEW

The City Attorney’s Office has reviewed the resolution and approved it as to form.

 

FINANCIAL IMPACT

Operating Budget Impact

The proposed action will not affect the City’s Operating Budget.

 

Capital Improvement Budget Impact

The proposed action will not affect the City’s Capital Improvement Budget.

 

Licensing

Before execution of any issued On-Site or Off-Site Construction Permits, the Subdivider secured a business license application and paid a Business License tax at the Contractors rate, as well as Administration and State fees for his contractors performing any improvements and shall renew accordingly.
