RECOMMENDATION
Staff recommends that the City Council:
1. Adopt Proposed Resolution approving Tract Map 20448 for the subdivision of nine (9) parcels into nine (9) residential condominium parcels of land to facilitate the development of 429 detached single-family dwelling units.
2. Delegate Authority to the City Manager or their designee to Execute all Related Documents.
BACKGROUND
On March 29, 2023, the City of Rialto Planning Commission conditionally approved Tentative Tract Map (TTM) No. 2022-0003, which had been assigned TTM No. 20448 by the map preparer. A copy of the Planning Commission staff report is included as Attachment 1. TTM No. 20448 shows the subdivision of approximately 40.96 gross acres of land (APNs: 0264-151-53, 0264-151-62, 0264-151-75, 0264-151-82, 0264-151-84, 0264-151-86, 0264-211-08, 0264-211-09, & 0264-212-08) located at the southwest corner of Ayala Drive and Scholl Way within the Renaissance Specific Plan into nine (9) residential condominium lots and eight (8) lettered lots for private streets, common open space/amenities, and water quality management.
ANALYSIS/DISCUSSION
Lennar Homes of California, LLC (the “Subdivider”) requests that the City Council approve Tract Map 20448 to subdivide nine (9) parcels of land (APNs: 0264-151-53, 0264-151-62, 0264-151-75, 0264-151-82, 0264-151-84, 0264-151-86, 0264-211-08, 0264-211-09, & 0264-212-08) located at the southwest corner of Ayala Drive and Scholl Way into nine (9) residential condominium parcels consisting of 429 detached single-family dwelling units. A copy of Tract Map 20448 is included as Attachment 2. The surrounding public streets are complete, with minor improvements that are required of this subdivision. The project is required to construct but is not limited to, public improvements such as pavement restoration, on-site public sewer main, on-site public water main, landscape & irrigation, streetlights, and driveway approaches. The Subdivider has submitted a Subdivision Improvement Agreement to guarantee completion of the remaining public improvements. A copy of the Subdivision Improvement Agreement is included in Attachment 3. A copy of the Disclosure Statement is included in Attachment 4.
The City Engineer has determined that the conditions of approval associated with TTM 20448 have been satisfied and that Tract Map 20448 is in substantial conformance with TTM 20448, and that Tract Map 20448 is ready for City Council approval.
Approval of a Tract Map is a ministerial action, and the City Council cannot condition its approval of the Tract Map and cannot impose new conditions on the project that were not previously identified at the time the Tentative Tract Map was approved.
ENVIRONMENTAL IMPACT
The potential impacts associated with proposed Project would either be the same or less than those described in the RSPA 2016 FEIR. In addition, there are no substantial changes to the circumstances under which the proposed Project would be undertaken that would result in new or more severe environmental impacts than previously addressed in the RSPA 2016 FEIR, nor has any new information regarding the potential for new or more severe significant environmental impacts been identified. The EIR Addendum to the RSPA 2016 FEIR is on file with the City of Rialto Planning Division.
GENERAL PLAN CONSISTENCY
The project is consistent with the following goals of the Land Use Element of the Rialto General Plan:
Goal 2-19: Encourage neighborhood preservation, stabilization, and property maintenance.
Goal 2-21: Ensure high-quality planned developments in Rialto.
LEGAL REVIEW
The City Attorney’s Office has reviewed the resolution and approved it as to form.

Operating Budget Impact
The proposed action will not affect the City’s Operating Budget.
Capital Improvement Budget Impact
The proposed action will not affect the City’s Capital Improvement Budget.
Licensing
Before execution of any issued On-Site or Off-Site Construction Permits, the Subdivider secured a business license application and paid a Business License tax at the Contractor rate, as well as Administration and State fees for his contractors performing any improvements and shall renew accordingly.
