RECOMMENDATION

Staff recommends that the City Council and Rialto Utility Authority Board:

1.                     Award a Construction Contract to Public Restroom Company in the amount of $1,298,364, for community center prefab building of the Rialto Habitat Nature Center, City Project No. 226; and

2.                     Authorize the City Manager/Executive Director to Execute all Related Documents.

 

BACKGROUND:

The City of Rialto has secured $5.20 million to date in state and federal grant funds to construct the Rialto Habitat Nature Center (RHNC). The grant funds, secured by Senator Leyva in June 2022 under California's 20th State Senate District priorities $1,050,000 in funding must be utilized by May 1, 2024.

 

On January 23, 2024, the City Council/Rialto Utility Authority (RUA) Board authorized staff to release bids for several items in support of the design and construction of RHNC. One of these items was for a community center prefab building for the RHNC. 

 

The community center building is designed to maximize its use of approximately 30’x60’ pad footprint and will boast a distinctive architectural style consistent with other City park facilities. Due to the site constraints, the 30’x60’ pad is the maximum available area. Its main entrance will feature a large double door that will lead directly into a spacious community room with high, vaulted ceilings. Natural light will flood the interior through the south-facing windows creating an inviting atmosphere for the City to host community educational events while overlooking the RHNC. Inside the community room, educational materials can adorn the walls, offering insights into the habitat and wetlands that can be found in the RHNC, while the room itself will serve as a versatile space for public events and educational workshops. At the back of the community room, a door will lead to a storage area that will include a convenient wash station with a sink. A 10’x10’ office will be accessible through the storage room. The office will provide an administrative space for staff and will feature a south-facing window overlooking the RHNC. On the opposite side of the building from the main entrance, separate exterior entrances will lead to the public restrooms, as well as to the utility chase for the community center.

 

The community building also integrates aesthetically appealing security features when the facility is not in use.

 

ANALYSIS/DISCUSSION

On March 18, 2024, RUA released Request for Proposal (RFP) No. 24-023, a statement of qualifications from modular building manufacturers for the Rialto Habitat Nature Center on the planetbids website. Several modular building manufacturers that previously bid and were awarded contracts with the City of Rialto were notified via email and telephone that RUA was requesting proposals to provide modular building specifications services for the RHNC project.

 

The bid closed on April 5, 2024, and RUA received one (1) proposal. The proposal was evaluated by the following committee to have met the qualifications of RFP No. 24-023:

At the request of the City Council/Rialto Utility Authority Board, staff met with City youths from the Rialto Teen Center to conduct a survey and receive feedback, which was incorporated into the Community Center.

 

Staff determined that the bid of $1,298,364 that was submitted by Public Restroom Company is responsive and reasonably consistent with the engineer cost estimate of $1.2 million. Furthermore, Public Restroom Company is properly licensed and qualified. ATTACHMENT 1 includes Public Restroom Company’s Disclosure Statement. ATTACHMENT 2 includes Public Restroom Company’s Contractor Licenses. Staff recommends that the City Council and Rialto Utility Authority Board accept the bid received from Public Restroom Company as the responsive bid. A professional services agreement with Public Restroom Company for the project is included as ATTACHMENT 3.

 

Staff updated the Water Subcommittee on March 26, 2024, that the RHNC community center was out to bid. The feedback from the Water Subcommittee was to bring this item to April 23, 2024, City Council/Rialto Utility Authority Board Meeting to award a contract to one of the firms that bid on the project. 

 

ENVIRONMENTAL IMPACT

Pursuant to Section 15378 of the California Environmental Quality Act, the proposed request is not a project. A ‘Project’ means the whole of an action, which has the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. A project does not include the creation of government funding mechanisms or other government fiscal activities that do not involve any commitment to any specific project, which may result in a potentially significant physical impact on the environment or organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

 

GENERAL PLAN CONSISTENCY

This action is consistent with Guiding Principle 3A in the General Plan:

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

LEGAL REVIEW

The City Attorney’s Office has reviewed the agreement and approved it as to form. 

 

FINANCIAL IMPACT

Operating Budget

There is no impact to the general fund with this action at this time.

 

Capital Improvement Budget

Grant funds of $1,050,000 secured by Senator Leyva appropriated in Account No. 56607860-53001, Phase 83: SWRCB will be used to fund a majority of the Community Center Building. The balance of $248,364 will be funded with the remainder of the $4.15 million in already secured state and federal funds. Staff will work with the managers of the granting agencies to maximize the matching requirements to most effectively utilize the remaining grants. The remaining grants will also be appropriated into Account No. 56607860-53001.
