Request City Council to: (1) Approve a One-Year Facility License Agreement Between the City of Rialto and Rialto Family Health Services (RFHS) for Office Space in Room 504 at the Carl Johnson Center; and (2) Authorize the City Manager or Their Designee to Execute All Necessary Documents Related to the License Agreement.

RECOMMENDATION
Staff recommends that the City Council:
1) Approve a one-year Facility License Agreement between the City of Rialto and Rialto Family Health Services for office space in Room 504 at the Carl Johnson Center; and
2) Authorize the City Manager or their designee to execute all necessary documents related to the License Agreement.
BACKGROUND
Rialto Family Health Services (RFHS) is a community-based nonprofit organization providing vital services in Rialto and the surrounding area since 2015, including:
• Back on Track Project: coaching and mentoring for adults navigating record expungement.
• Veterans Assistance Program: helping veterans access earned benefits.
• Various other initiatives like mental health, cooking education, and caregiver support.
RFHS has utilized Room 504 at the Carl Johnson Center since 2015, under a rent-free MOU approved by Resolution No. 6992. This MOU expired, and on November 15, 2022, the City Council approved a Facility License Agreement granting RFHS use of the space for eight months, with two optional one-year extensions. RFHS wishes to continue to occupy the space within Building 500; City staff and RFHS are requesting to enter into a new agreement.
ANALYSIS/DISCUSSION
RFHS fulfills critical community health needs through coaching, mentoring, and social services, fully aligning with Rialto’s mission to support resident wellness and empowerment.
Key terms of the proposed Agreement include:
• Office Space: Continued use of Room 504, Monday-Friday during Community Center hours.
• City Support: Provision of utilities, custodial services, and facility maintenance, with scheduling coordinated by Parks & Recreation.
• Fees & Term: A one-year term with a $500 annual license fee; either party may terminate with 30 days’ written notice.
The proposed License Agreement mirrors the previous Council-approved agreement between the City and RFHS.
ENVIRONMENTAL IMPACT
This request is not a Project as defined by Section 15378 of the California Environmental Quality Act (CEQA) Guidelines. A “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. Pursuant to Section 15378 (b)(5), a project does not include organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.
GENERAL PLAN CONSISTENCY
This action is consistent with Guiding Principle 3A in the General Plan:
“Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.”
LEGAL REVIEW
The City Attorney's Office has reviewed the agreement and approved it as to form.
FINANCIAL IMPACT
Operating Budget Impact
The City currently budgets for and provides overall maintenance of the Carl Johnson Center. Approval of this action would generate rental revenue of $500 annually.
Capital Improvement Budget Impact
No Impact.
Licensing
Business License fees for non-profit organizations are assessed at a reduced rate. A $36.40 fee is due annually.
