BACKGROUND
On August 30, 2023, the City of Rialto Planning Commission conditionally approved Tentative Tract Map (TTM) No. 2022-0002 which had been assigned TTM No. 20550 by the San Bernardino County Recorder’s Office. A copy of the Planning Commission staff report is included as Attachment 1. TTM No. 20550 shows the subdivision of approximately 0.91 gross acres of land, Assessor’s Parcel Numbers (APNs) 0253-151-59, 0253-151-60, and 0253-151-71, located on the east side of the future extension of Cornell Street between Ashford Avenue and the future extension of Sandalwood Avenue within the Single-Family Residential (R-1A) zone into eight Single-Family Lots.
ANALYSIS/DISCUSSION
Apple 7, LLC (the “Subdivider”) requests that the City Council approve Tract Map 20550 to subdivide three parcels of land (APNs: 0253-151-59, 0253-151-60, and 0253-151-71) located on the east side of the future extension of Cornell Street between Ashford Avenue and the future extension of Sandalwood Avenue within the Single-Family Residential (R-1A) zone into eight Single-Family Lots. A copy of Tract Map 20550 is included as Attachment 2. The subdivision is required to construct, but is not limited to, public improvements such as asphalt concrete and aggregate base for new streets, sidewalk, curb and gutter, public sewer main, public water main, and streetlights. The Subdivider has submitted a Subdivision Improvement Agreement, with necessary security bonds, to guarantee completion of the required public improvements. A copy of the Subdivision Improvement Agreement is included in Attachment 3. A copy of the Disclosure Statement is included in Attachment 4.
The City Engineer has determined that the conditions of approval associated with TTM 20550 have been satisfied, Tract Map 20550 is in substantial conformance with TTM 20550, and that Tract Map 20550 is ready for City Council approval.
Approval of a Tract Map is a ministerial action, and the City Council cannot condition its approval of the Tract Map and cannot impose new conditions on the project that were not previously identified at the time the Tentative Tract Map was approved.
