Recommendation
Staff recommends that the City Council:

1) Introduce Ordinance, "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RIALTO AMENDING MISCELLANEOUS SECTIONS IN THE RIALTO MUNICIPAL CODE TO PROVIDE THE PUBLIC WORKS DIRECTOR WITH THE SAME AUTHORITY AS THE CITY ENGINEER," by title only and waive further reading; and
2) Provide any other direction as determined appropriate.

BACKGROUND:
In order to facilitate conducting City business, providing the Public Works Director with the same authority as the City Engineer will increase the City's flexibility in completing City projects.

ANALYSIS/DISCUSSION:
The municipal code includes a significant number of provisions across most titles that provide the City Engineer with certain authority. A few examples include, under Chapter 2.48, Purchasing, the City Engineer handles certain aspects of public project procurement, under Chapter 5.44, Cable Systems Regulations, the City Engineer has approval authority over system construction, and under Chapter 10.41, Interstate Trucks, the City Engineer has authority over the designation of truck routes.

The municipal code rests much authority and responsibility on the City Engineer. Some of this work can be managed as effectively by the Public Works Director. In some cases, the authority can be shared with the Public Works Director only if the director is a registered Professional Engineer in California, and that language has been added in all the relevant provisions.
