Request City Council to Adopt Budget Resolution No. 7236 Accepting the CalRecycle Tire-Derived Product Grant in the Amount of $149,986.

BACKGROUND:
The California Department of Resources Recycling and Recovery (CalRecycle) offers the Tire-Derived Product Grant Program pursuant to Sections 42872, 42873, and 42889 of the Public Resources Code. The purpose of the grant is to decrease the adverse environmental impacts created by the unlawful disposal and stockpiling of waste tires.
The City of Rialto is an eligible applicant for the Tire-Derived Product Grant Program through the CalRecycle (18th Cycle) for Fiscal Year 2017-2018. On April 25, 2017 the City Council approved Resolution No. 7108 authorizing the Submission of the Grant Application for $150,000 to CalRecycle for Rubberized Mulch. CalRecycle awarded the grant on June 7, 2017 in the amount of $149,986. The term of the grant is from August 1, 2017 to April 1, 2020 (See Attachment 1).
ANALYSIS/DISCUSSION:
A component of the CalRecycle grant application process was to create a work plan. Staff proposed to provide weed abatement mulch cover within the interior and exterior of the Easton and Cedar Reservoir Facilities (See Attachment 2 & 3). Weeds will be removed and sterilant will be applied prior to spreading the rubberized mulch. This will help to minimize the need for weed abatement in the future.
The exterior landscaping at the Easton Reservoir facility was converted to drought tolerant landscaping in May of 2017 and the Cedar Reservoir facility is scheduled for conversion in winter 2018 with the use of rubberized mulch material from the subject grant. Staff anticipates completion of the project by June 2018.
ENVIRONMENTAL IMPACT:
The proposed request is not a “Project” as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.
GENERAL PLAN CONSISTENCY:
This action is consistent with Guiding Principle 3A in the General Plan:
Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.
LEGAL REVIEW:
The City Attorney has reviewed and approved the staff report and Resolution.
FINANCIAL IMPACT:
The awarded CalRecycle grant is in the amount of $149,986. Upon acceptance of the grant, staff recommends increasing estimated revenue in the Grant Project Fund Account No. 223-400-7302-7536-180203 in the amount of $149,986 for the CalRecycle Tire-Derived Products with a corresponding appropriate increase in budgeted expenditures in the Grant Project Fund Account No. 223-500-7302-3001-180203.
RECOMMENDATION:
Staff recommends that the City Council Adopt the Budget Resolution accepting the CalRecycle Tire-Derived Product Grant in the Amount of $149,986.
