Request City Council to Adopt Resolution No. 7224 approving a Memorandum of Understanding (MOU) between the City of Rialto and the Kiwanis Club of East Rialto providing Kiwanis Club meetings and Bingo presentations served out of the Grace Vargas Senior Center and Waiving Rental Fees.

BACKGROUND:

The Kiwanis Club of East Rialto has been serving the Rialto Community for more than 50 years. As an organization, the Kiwanis Club is an international, coeducational service club founded in 1915 in Detroit, Michigan. The Club can be found in more than 80 nations and geographic areas. The organizational mission is to come together, united in a desire to serve children.   The Kiwanis of East Rialto fundraises annually and is currently providing Bingo presentations once a week on Fridays inside the Grace Vargas Senior Center.  The City would like to continue the Kiwanis use of the facility with a Memorandum of Understanding (MOU).

 

ANALYSIS/DISCUSSION:

The Kiwanis Club of East Rialto is conducting Bingo as a fundraiser. The purpose of providing an MOU is to confirm approval of the terms governing the acceptance and the use of the City’s facility. The Grace Vargas Senior Center offers a supportive environment for Bingo. The approval of an MOU will allow the Kiwanis Club of East Rialto the continued use of the Berglund Room to conduct Bingo Fundraising on Fridays at specified times during normal business hours of the Grace Vargas Senior Center.  The term of the MOU is to be for three years, with facility usage rules, regulations, and obligations by the club.

 

Monies raised from Kiwanis Club of East Rialto activities, including bingo, provide for materials, supplies, and gifts for its annual programming. In the City of Rialto, the East Rialto Kiwanis partners with the City as a co-sponsor of the Drowning Prevention/Safety Fair.  As co-sponsor, the Kiwanis help to provide public education and drowning prevention initiatives, educating Rialto residents - especially, children on safety at home, reducing the number of water-related fatalities and near drowning incidents through the promotion of key water safety messages.  Having the use of the Senior Center for meetings and providing Bingo at the Senior Center helps to further the service mission of the Kiwanis Club of East Rialto. 

 

The Grace Vargas Senior Center facility offers a location and built-in structure for providing Bingo.  The Friends of the Senior Center have and will continue to provide Bingo at the Center for many years and continue to have games on Tuesdays from 1:30pm-3:30pm. The Center is accessible to residents using public and private transportation and although Bingo is offered by Friends of the Senior Center already, those dates do not conflict with the Friday Kiwanis Club Bingo offering. The Friends of the Senior Center have agreed to assist the Kiwanis Club of East Rialto in this endeavor. 

 

Because the activities involve fundraising for the Kiwanis as a club. The City is charging an annual fee of $500 as a reasonable fee for recapturing a portion of the City costs for providing the space.  Per the City’s fee schedule, the full rental fee would be $4,128.00 annually.  In light of the community benefits provided by the Kiwanis, including the public education and drowning prevention initiatives implemented by Kiwanis, a valid public purpose would be served by waiving the full rental fees and charging the $500 to offset the City’s costs.

 

ENVIRONMENTAL IMPACT:

The requested action is not a “Project” as defined by the California Environmental Quality Act (CEQA).  Pursuant to Section 15378(a), a Project means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  According to Section 15378(b), a Project does not include:  (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

 

GENERAL PLAN CONSISTENCY:

This action is consistent with the City of Rialto General Plan Goal and Policies

Guiding Principles 3C & 4A in the General Plan:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Our community will support the creation and maintenance of attractive parks, recreational facilities, and gathering places that meet the needs of our residents.

 

LEGAL REVIEW:

The City Attorney has reviewed and approved the staff report and Memorandum of Understanding.

 

FINANCIAL IMPACT:

There have been no annual revenues collected.  Expected revenue for the time period covered by this MOU is estimated at $1,500.

 

LICENSING:

Business License Tax is zero - based on non-profit status. Administrative fee of $29.70 is due annually.

 

RECOMMENDATION:

Staff recommends that the City Council Authorize the City Administrator to execute the Memorandum of Understanding between the City of Rialto and the Kiwanis Club of East Rialto.
