Request City Council to (1) Approve a First Amendment to the Professional Services Agreement with IDS Group, Inc., in the amount of $36,231 for Civil and Architectural Design Services for Rialto Community Center ADA Path of Travel and Rialto Community Center Rehabilitation of Buildings 200 - 500; and Request City Council to (2) Authorize the Release of Request for Bids No. 18-061 for Rialto Community Center ADA Path of Travel; and (3) Authorize Request for Bids No. 18-062 for Rialto Community Center Rehabilitation Buildings 200 - 500.

BACKGROUND:

The City of Rialto currently operates the Rialto Community Center located at 214 N. Palm Avenue.  In fiscal year 2014/2015, the City Council authorized funds for the rehabilitation of Buildings 200, 300, 400 and 500.

 

On August 8, 2017, the City Council approved a Professional Services Agreement (PSA) with IDS Group, Inc., for the preparation of architectural design Services for the Rehabilitation of Buildings 200, 300, 400 and 500 in the amount of $86,632.

 

ANALYSIS/DISCUSSION:

Additional work was identified during the design process through additional assessments conducted with the Building & Safety Division and during the review and preparation of an ADA Path of Travel (POT) Deficiency Map.  During this process, additional ADA deficiencies were identified which were not included in the original scope of work.  The additional deficiencies are associated with the gymnasium restrooms and access to those restrooms as well as the POT to and from disabled parking spaces in the parking lot located on the southeasterly side of the Community Center. 

 

The gymnasium restrooms are not currently in compliance with ADA and the gymnasium building was not included in the initial scope of work, which included Buildings 200 through 500.  It was also not envisioned that there would need to be modifications to the existing parking area, but it was identified during the field review with the Building & Safety Division. 

 

At one time, the gymnasium restrooms had been closed to public access, but they are currently open for use and are needed for activities in the gymnasium.  The identified improvements are required with the proposed building improvements and rather than programming a future phase, staff recommends including the gymnasium restrooms and parking area in the current project.

 

IDS Group, Inc. was requested to provide a scope and fee for the additional services that were not a part of the original scope of work.  The First Amendment to the PSA and consultant proposal is included as Attachment 1

 

On December 5, 2017, the Recreation and Parks Commission reviewed and recommend for City Council approval the conceptual plan for buildings 200, 300, 400 and 500, included as Attachment 2.

 

A Release of Request for Bid - ADA Path of Travel RFB #18-061 to retain a contractor is required. The tentative schedule for the bid process is as follows:

ENVIRONMENTAL IMPACT:

This request is not a “Project” as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will result in direct or indirect physical changes in the environment.

 

GENERAL PLAN CONSISTENCY:

This action is consistent with Guiding Principle 3A in the General Plan:

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Approval of this action also complies with the City of Rialto General Plan Goal and Policies:

Goal 3-11:                      Provide community facilities that adequately support established programs, can accommodate future needs, and are accessible to all members of the community.

 

Goal 3-11.1: Allocate resources for the maintenance and operations of City facilities; explore alternative funding options for maintenance and operational costs of new facilities.

 

LEGAL REVIEW:

The City Attorney has reviewed and approved the staff report and First Amendment.

 

FINANCIAL IMPACT:

Sufficient budget is available in the General Capital Fund Account No. 300-500-8341-3001-150305-03 for the additional amount of $36,231 for the First Amendment with IDS Group, Inc.

 

LICENSING:

A Business License application and payment of a Business License tax at the Professional Service rate in the amount of $104 will be paid by the vendor prior to execution of Amendment No. 1 to the subject Professional Services Agreement.

 

RECOMMENDATION:

Staff recommends that the City Council:

 

                     Approve the First Amendment to the Professional Services Agreement with IDS Group, Inc. in the additional amount of $36,231 for a total cumulative not-to exceed amount of $122,863.

 

                     Approve conceptual plan for buildings 200, 300, 400 and 500 as recommended by the Parks and Recreation Commission,

 

                     Authorize the Release of Request for Bids No. 18-061 for the Rialto Community Center ADA Path of Travel Project (City Project No 150305), and

 

                     Authorize the Release of Request for Bids No. 18-062 for the Rialto Community Center Rehabilitation of Buildings 200-500 (City Project No. CB1804).
