BACKGROUND:

The California Legislature recently passed, and Governor Edmond G. Brown Jr. signed into law, Senate Bill 1 (SB1) - The Road Repair and Accountability Act of 2017, a transportation funding bill that will provide a reliable source of funds to maintain and integrate the State’s multi-modal transportation system.  SB 1 funding nearly doubles the resources available in the 2017 Active Transportation Program (ATP), including an additional $40 million to support projects in the Southern California Association of Governments (SCAG) regional program.  The award letter is included as Attachment 4. 

 

In the late 1980’s, the City developed a bike path along the west side of Cactus Avenue between Rialto Avenue and Baseline Road.  City staff worked with San Bernardino County Flood Control District (SBCFCD) to acquire a Common Use Agreement for a bicycle pathway.  The initial work included an asphalt concrete path constructed along the route. 

 

In 2010, the City contracted with Architerra Design Group to prepare conceptual plans for the development of Cactus Trail Conceptual Plans.

 

ANALYSIS/DISCUSSION:

On February 28, 2018, Rialto received notification from SCAG of the grant award for $1,260,000 toward the proposed project, which encompasses the design and construction of a multi-use trail along the west side of Cactus Avenue along the San Bernardino Flood Control Channel between Rialto Avenue and Baseline Road.  This project will enhance linkages to other facilities (schools, parks, public transportation, etc.) and enhance the quality of life and benefits to the community.  Design and construction of the Cactus Avenue Trail will follow the City of Rialto’s recently adopted Landscape Design Guidelines and specifications for Landscape Development; the Landscape Architectural Development Plan Requirements; and the Irrigation, Planting and Maintenance Requirements in conformance with the requirements of the California Water Efficient Landscape Ordinance AB1881 relative to drought tolerant landscaping.

 

The proposed Professional Services Agreement PSA is for engineering, landscape architecture, and grant administration services for the design and construction of the Cactus Trail.  The Public Works Department prepared Request for Proposals (RFP) No. 17-132 to solicit proposals from professional firms to provide engineering, landscape architecture and grant administration services.  A copy of RFP No. 17-132 is included as Attachment 1.

 

The City released RFP No. 17-132 on June 26, 2017.  The City published the Notice Inviting Proposals on the City of Rialto’s website and the Planet Bid website.

 

On July 27, 2017, the City received six proposals in response to the RFP from the following firms (in alphabetical order):

1.                     Architerra Design Group - Rancho Cucamonga, CA

2.                     IDS Group Inc. - Irvine, CA

3.                     KOA Consultants - Ontario, CA

4.                     KSA Design Studio, Inc. - Marina Del Rey, CA

5.                     Land Engineering Consultants, Inc. - Yucaipa, CA

6.                     Willdan Engineering - Rialto, CA

 

The City assembled an evaluation panel to review the submitted proposals.  The proposal evaluation panel consisted of the following members:

 

Cameron Brown, Senior Planner (San Bernardino County Transportation Agency)

Katie Nickel, Program Coordinator (Public Works Department)

Gene Klatt, Project Engineer (Public Works Department)

Lonny Young, Project Engineer (Public Works Department)

 

Three firms were short-listed to participate in interviews.  The selection panel interviewed the following firms (in alphabetical order):

 

                     Architerra Design Group - Rancho Cucamonga, CA

                     KOA Consultants - Ontario, CA

                     Willdan Engineering - Rialto, CA

 

Staff verified firm qualifications and references for similar work.  The proposal and interview indicated KOA Consultants demonstrated qualifying professional experience in providing similar services in previous work performance.  The qualifying experience demonstrated that the consultant completed previous work in a satisfactory manner.  Based on the submitted proposal, interview, reference check, and qualifying work experience; the evaluation panel concluded that KOA Consultants was the most qualified firm to provide engineering and landscape design services for the Cactus Trail Design.  Staff reviewed the cost proposal submitted by KOA Consultants and found it to be appropriate for the identified scope of work.  The preliminary construction cost estimate for the project is $1,260,000.  The design cost is approximately 14% of the estimated construction cost.  The Schedule of Compensation is included as Exhibit “C” to the Professional Services Agreement.  The anticipated schedule is as follows:

A copy of the KOA Corporation proposal is included as Attachment 2.  A copy of the Professional Services Agreement is included as Attachment 3.  The consultant has provided the required Disclosure Form.  The Disclosure Form is included as Attachment 5.

 

ENVIRONMENTAL IMPACT:

This request is not a “Project” as defined by the California Environmental Quality Act (CEQA).  Pursuant to Section 15378(a), a “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

 

GENERAL PLAN CONSISTENCY:

This action is consistent with Guiding Principle 3A in the General Plan: 
Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business. 

 

Approval of this action also complies with the City of Rialto General Plan Goal and Policies:

 

Goal 3-11: Provide community facilities that adequately support established programs, can accommodate future needs, and are accessible to all members of the community.

Goal 3-11.1: Allocate resources for the maintenance and operations of City facilities; explore alternative funding options for maintenance and operational costs of new facilities.

 

LEGAL REVIEW:

The City Attorney has reviewed and approved the staff report and professional services agreement.

 

FINANCIAL IMPACT:

Operating Budget Impact

Anticipated maintenance average costs are $40,000 per year for the Cactus Trail.  This includes landscape maintenance, trimming, weeding, irrigation, trash pickup and collection.

Capital Improvement Budget Impact

Sufficient funds are budgeted and available in FY2017/2018 to cover the cost of design and engineering services for the proposed Cactus Trail Improvements.  The design of Cactus Trail Improvements between Rialto Avenue and Baseline Road by KOA Corporation, in the amount of $172,375, will be charged to Open Space Development Fund Account No. 220-500-8348-3001-170801-01.  The City was awarded an Augmented 2017 Active Transportation Program Grant in the amount of $1,260,000 for the construction of the Cactus Trail Improvements.

 

Licensing

A Business License application and payment of a Business License tax at the Professional Service rate in the amount of $254.00 will be paid by the vendor prior to execution of the Professional Service Agreement/Construction Contract/Purchase Order.

 

RECOMMENDATION:

Staff recommends that the City Council:

                     Adopt the Resolution accepting the Augmented 2017 Active Transportation Program Grant funding for active transportation through the Road Repair and Accountability Act of 2017, Senate Bill 1 (SB1);

                     Approve the Professional Services Agreement with KOA Inc., in the amount of $194,025 for design of Cactus Trail Improvements Project No. 170801.
