Request City Council to Award a Construction Contract to TSR Construction and Inspection in the Amount of $42,400 for the Bud Bender Park Field Lights Project, City Project No. CB1801.

BACKGROUND:

Bud Bender Park is a nine-acre park located at 235 N. Lilac Avenue.  Amenities the park provides are Playgrounds, Walking Path, Community Gardens, and Baseball Facilities.

 

On January 9, 2018, City Council approved the construction drawings and contract specifications, and authorized the release of RFB No. 18-058 for the project.  A copy of the staff report is included as Attachment 1.

 

ANALYSIS/DISCUSSION:

The City released RFB No.18-058 on March 29, 2018 and published a Notice Inviting Bids in the San Bernardino County Sun on March 31, 2018 and April 7, 2018; the City published the Notice Inviting Bids on the City of Rialto website and provided the construction documents on the Planet Bids web site.  On May 3, 2018, the City received three (3) bids, tabulated as follows:

The City’s engineering construction estimate was $30,000.  The lowest responsive bid received was $42,400, submitted by TSR Construction and Inspection and the bid document is included as Attachment 2.  Staff reviewed the bid, references, and contractor’s licenses, and found the Contractor to be properly licensed, and qualified.  The Submitted Bid is included as Attachment 2

 

Chapter 2.47 of the Rialto Municipal Code includes provisions for local preference to firms located in Rialto for non-construction contracts; however, as a general law city, Rialto must award construction contracts to the lowest responsible bidder, thus the provisions of Chapter 2.47 do not apply.  The construction contract with TSR Construction and Inspection is included as Attachment 3.

 

ENVIRONMENTAL IMPACT:

Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act (CEQA).  The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA.  In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared categorically exempt from the requirement for the preparation of environmental documents.  In accordance with Section 15301 “Existing Facilities”, Class 1 projects consist of the minor alteration of existing public structures or facilities, therefore, the Bud Bender Park Field Lights Project, City Project No. CB1801 is considered categorically exempt from CEQA.  Staff prepared and filed a Notice of Exemption for the project.

 

On October 23, 2017, the City filed a Notice of Exemption for the project pursuant to CEQA, included as Attachment 4

 

GENERAL PLAN CONSISTENCY:

Approval of this action complies with the following City of Rialto Guiding Principles, General Plan Goals and Policies:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Goal 2-24:                     Take advantage of opportunities to increase and enhance open spaces throughout Rialto.

 

Goal 2-27:                     Provide a variety of park facilities that meet the diverse needs and interest of the community.

 

Policy 2-27.1:                     Establish a Master Plan for Parks and Recreation that achieves a park ratio of 3.0 acres per 1,000 residents, evenly distributes park facilities throughout the community, and contains strategies for funding facilities and maintenance.

 

Policy 2-27.2:                     Plan for and designate adequate funding to maintain new and existing parks and facilities.

 

LEGAL REVIEW:

The City Attorney has reviewed and approved the staff report and construction contract.

 

FINANCIAL IMPACT:

Operating Budget Impact

The proposed action will not affect the operating budget

 

Capital Improvement Budget Impact

Funds are budgeted and available from General Fund Capital 300 funds as identified in the funding source for the Bud Bender Field Lights Project No. cb1801.

 

Funds in the amount of $42,400 for the Bud Bender Park Field Lights Project are budgeted and available in Account No. 300-500-8341-3001-CB1801 as shown in Table 1 below:

LICENSING

The vendor will submit a business license application and pay a Business License Tax at the Service rate in the amount of $98.00 dollars along with the Administration Fee and State Fee.

 

RECOMMENDATION:

Staff recommends that the City Council Award a Construction Contract to TSR Construction and Inspection, a California corporation, in the amount of $42,400 for the Bud Bender Park Field Lights Project, City Project No. CB1801.
