Request City Council to Approve Amendment No. 1 to the Cooperative Agreement with the County of San Bernardino for the North Bloomington Chip Seal Project, Reducing the City’s Share of the Cost by $53,049.

BACKGROUND:

The County of San Bernardino staff has proposed two joint cooperative projects in the North Bloomington area where the City of Rialto and County of San Bernardino share common boundaries.  The first project will provide accessible curb ramps.  The second project will provide pavement maintenance including crack sealing, patching, chip seal, and fog seal.  On some streets, the work will also include an asphalt concrete leveling course.

 

Sections 1685 and 1803 of the California Streets and Highways Code authorize the City to contract with the County of San Bernardino for maintenance, construction, or repair of streets and roads, whenever the City Council determines that it is necessary for the more efficient maintenance, construction, or repair of streets and roads within the City.

 

On March 28, 2017, City Council approved a Cooperative Agreement with the County of San Bernardino for the North Bloomington Chip Seal Project; and adopted Resolution No. 7103 amending the 2016-17 Fiscal Budget appropriating $138,203 for the North Bloomington Chip Seal Project, City Project No. 170816.  The staff report and agreement are included as Attachment 1.

 

ANALYSIS/DISCUSSION:

The County of San Bernardino is the lead agency for the North Bloomington Chip Seal Project.  During project preparation work, the County of San Bernardino Department of Public Works Operations (DPW) staff determined that two segments should be excluded from the project because the pavement condition requires more than a chip seal treatment.  DPW also determined that a very small segment of Jurupa Avenue should be added to the project.

 

With Amendment No. 1 to the Cooperative Agreement, the City of Rialto and the County of San Bernardino desire to:

 

(1)                     Remove from the project scope:

                     Cedar Avenue (from 0.03 mile south of Church Avenue to 0.32 mile north of Church Avenue), and

                     Valley Boulevard (from Claremont Avenue east to Spruce Avenue);

 

(2)                     Add to the project scope:

 

                     Jurupa Avenue (from City limit to 105 feet westerly); and

 

(3)                     Amend the City’s share of the total project cost to a revised estimated amount of $85,154; reducing the original estimated cost of $138,203 by $53,049.

 

The County of San Bernardino staff prepared Amendment No. 1 and an updated project location map.  A copy of Amendment No. 1 is included as Attachment 2.  A copy of the updated project location map is included as Attachment 3.

 

Staff expects start of construction for the project in the fall of 2018.

 

ENVIRONMENTAL IMPACT:

As lead agency, the County of San Bernardino will be responsible for compliance with the California Environmental Quality Act (CEQA).  Section 21084 of the California Public Resources Code requires California Environmental Quality Act (CEQA) Guidelines to include a list of classes of projects that have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA.  In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared categorically exempt from the requirement for the preparation of environmental documents.  In accordance with 14 CCR Section 15301 “Existing Facilities”, Class 1 projects consist of the repair, maintenance, or minor alteration of existing public structures or facilities, involving negligible of use beyond that existing at the time of the lead agency’s determination.  Based on the Class 1 exemption, the North Bloomington Chip Seal Project will be considered categorically exempt from CEQA.  County of San Bernardino will prepare and file the Notice of Exemption for the project.

 

GENERAL PLAN CONSISTENCY:

This action is consistent with Guiding Principle 3A in the General Plan:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Approval of this action also complies with the City of Rialto General Plan Goal and Policies:

 

Goal 4-1:                     Provide transportation improvements to reduce traffic congestion associated with regional and local trip increases.

 

Policy 4-1.1:                     Establish and maintain standards for a variety of street classifications to serve both local and regional traffic, including Major Arterial Highways, Major Arterials, Secondary Arterials, Collector Streets, and Local Streets.

 

LEGAL REVIEW:

The City Attorney has reviewed and approved the staff report and Amendment No. 1 to the Cooperative Agreement.

 

FINANCIAL IMPACT:

Operating Budget Impact

The proposed action will not affect the Operating Budget.

 

Capital Improvement Budget Impact

On March 28, 2017, City Council approved an appropriation from the Measure I Fund Account for $138,203 for the North Bloomington Chip Seal Project.  Approval of Amendment No. 1 will reduce the City’s share of the total project cost by $53,049 for a revised estimated cost of $85,154, which is currently budgeted in the Measure I Fund Account No. 201-500-4310-3001-170816-05. 

 

The City will reduce Purchase Order No. 2017-1917 issued to San Bernardino County for this project by the amount of $53,049, establishing a new amount of $85,154.

 

Licensing

The proposed action will not require the payment of a business license tax.

 

RECOMMENDATION:

Staff recommends that the City Council approve Amendment No. 1 to a Cooperative Agreement with the County of San Bernardino for the North Bloomington Chip Seal Project.
