Request City Council Adopt Resolution No. 7427 Dissolving the Corridor Design Authority and Terminating the Authority’s Joint Exercise of Powers Agreement.

BACKGROUND:

The Corridor Design Authority (210 Foothill Freeway) Joint Powers Authority (JPA) was formed on September 13, 1994 to assist cities with the planning and design of the 210 Foothill Freeway extension.  The 7 cities included Claremont, Fontana, La Verne, Montclair, Rancho Cucamonga, Rialto, and Upland.  After the state completed the freeway in November 2002, the Authority continued to meet 4 times per year until 2010 when it agreed to meet 3 times per year.  The Joint Exercise of Powers Agreement is attached hereto as Exhibit A.

 

ANALYSIS/DISCUSSION:

Attendance has steadily declined for the last 7 years and the Authority has struggled to find reasons to meet and topics for discussion.  In the past, the Authority addressed many on-going issues of interest including freeway landscaping, maintenance and billboards as well as trail issues across the foothill cities.  The cities have also used this JPA meeting as a method of communication with Caltrans in both Districts 7 and 8 (Los Angeles and San Bernardino Counties).  The Authority effectively facilitated a regional approach to solving these issues associated with the new freeway.

 

The Authority concluded that it has outlived its original purpose.  On October 9, 2018, the Authority requested that each City Council for the member cities dissolve the JPA since the Authority is currently serving in an informational capacity and other communication vehicles remain available.  The Authority has no assets to distribute upon dissolution, as its duties consisted of meetings only.

 

ENVIRONMENTAL IMPACT:

Pursuant to Section 15378 of the California Environmental Quality Act, a “Project’ means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  A Project does not include the creation of government funding mechanisms or other government fiscal activities, which do not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment.

The proposed action is consistent with the following Guiding Principle of the General Plan:

 

 “Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.”

The City Attorney has reviewed and approved this staff report and the Resolution.
