BACKGROUND:

The Police Department Street Crime Attack Team (SCAT) currently operates four (4) Ford Crown Victoria Police Interceptors for patrol, special operations and gang enforcement.

 

The 2007 Ford Crown Victoria’s have very high odometer readings and have been in service since 2007.  Over the course of the last twelve (12) months each of these vehicles have been down for repairs on numerous occasions, making them unreliable and unavailable for officer’s use. Purchase of replacement vehicles will reduce maintenance costs and safety hazards for the operators.

 

ANALYSIS/DISCUSSION:

During the 2018/2019 budget analysis the City Council authorized $250,000 for the purchase of Police Department vehicles.  Dodge Chargers are currently in use by various police agencies in the area most notably San Bernardino Sheriff’s, Colton Police, California Highway Patrol and Upland Police  The Dodge Charger will be used by SCAT patrol personnel and replace the Four current Crown Victoria’s with excessive mileage and mechanical issues. Crown Victoria Police Interceptors are no longer manufactured for law enforcement purposes.

 

Piggybacking Purchasing

On September 05, 2018 the City of Upland started accepting bids for three Dodge Charger Police vehicles through requests for Proposals IFB No. 2019-08. The City of Upland issued a purchase order on October 15, 2018 for the purchase of the vehicles from Bravo Chrysler Dodge Jeep Ram (CDJR) of Alhambra, as a result of their bidding process and their winning bid.

 

The City’s Purchasing Ordinance allows for piggybacking on another Public Entity’s contract. The City of Rialto Municipal Code 2.48.210 General - Cooperative Purchasing Agreements ("Piggybacking") states:

 

 “Where advantageous for the City, the Purchasing Manager is authorized to purchase supplies, materials, equipment and contractual services through legal contracts of other governmental jurisdictions or public agencies without further contracting, solicitation, or formal bidding, provided such practice otherwise complies with state law.  This practice is commonly referred to as "piggybacking".  Utilization of cooperative purchasing agreements must include:

a)  Minimal change in specifications from original bid.

b) Copy of the request for bids and all bids received for the subject item(s) by the

     originating agency.

c)  Authorization from the originating agency to use the bid.

d) Authorization and agreement from the vendor to supply the supplies, materials,

    equipment or services in accordance with the terms of the bid.

e) Utilization of CMAS, GSA or County established contracts.”

 

The City of Rialto will not take delivery of any vehicles prior to final inspection and acceptance.

Attached is the request for proposal released by the City of Upland accompanied by their award of contract, Attachment A and B. Attachment C is Bravo CDJR of Alhambra’s confirmation to price match the City of Upland’s contract.

 

Modifications are necessary to equip these vehicles for police enforcement.  These modifications will include the installation of a police band radio.  The current radio in use by the Rialto Police Department is the Motorola APX 6500. Total cost for the purchase of four (4) radio packages is not to exceed $21,240.68. As on previous purchases, the department intends to purchase from Motorola Solutions, Inc. via a Piggyback Purchase through the Los Angeles County’s Contract #MA-IS-1740313-1, expires June 30, 2020, which is also an acceptable purchase as specified under Rialto Municipal Code 2.18.210. The contract is attached to this Staff Report at Attachment D.

 ENVIRONMENTAL IMPACT:

The proposed action is not a “Project” as defined by the California Environmental Quality Act (CEQA).  Pursuant to Section 15378(a), a “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  According to Section 15378(b), a Project does not include:  (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

GENERAL PLAN CONSISTENCY:

The City of Rialto has outlined key goals and objects relating to public safety.  The purchase of this technology is in consistence with meeting these objectives.

Goal 5-8:  Provide effective and comprehensive policing services that meet the safety needs of Rialto.

LEGAL REVIEW:

The City Attorney has reviewed and approved this staff report

 

FINANCIAL IMPACT:

Operating Budget Impact

No immediate impact to operating budget.

 

Capital Improvement Budget Impact

Funding in the amount of $127,680.96 is available in Police Department Rolling Stock Account No. 300-500-6150-3050 for the purchase of four (4) 2019 Dodge Charger Police Sedans in the amount of $106,440.28, and four (4) Motorola APX 6500 radios totaling $21,240.68.  Per Rialto Municipal Code Section: 2.48.145 a vendor disclosure form is attached for each vendor.

 

Licensing

The Rialto Police Department will be purchasing vehicles and police band radios from vendors outside Rialto City limits.  A business licenses from these vendors are not needed for this transaction.

 

RECOMMENDATION:

Staff recommends that the City Council:

 

                     Approve the purchase of four (4) Dodge Charger police vehicles through CDJR of Alhambra for the total amount of $106,440.28.

 

                     Approve the purchase of four (4) APX 6500 unit radios from Motorola Solutions, Inc. for the total cost of $21,240.68.
