Title
Request City Council Approve a Grant of Easement Agreement for Communication Facilities by and between the City of Rialto and Pacific Bell Telephone Company.

BACKGROUND:
During the course of constructing Linden Avenue and installing utilities, ATT (dba Pacific Bell Telephone Company) installed underground facilities within the landscape easement area along Linden Avenue. The landscape easement is not within the public right-of-way. In this case, the City of Rialto owns the underlying fee for the landscape easement, although the property is under contract with LHR for future development. ATT requests that the City grant an easement encompassing approximately 250 square feet located approximately 1,035 feet south of Renaissance Parkway on the east side of Linden Avenue.
ANALYSIS/DISCUSSION:
The ATT facilities serve the Renaissance Specific Plan and the proposed Easement does not significantly impair the development potential of the City's property. LHR recommends granting of the Easement attached hereto as Exhibit A and grants the City authorization to encumber the property in accordance with Section 5.10(c) of the Second Amended and Restated Contract of Sale.
ENVIRONMENTAL IMPACT:
On December 12, 2016, the City Council certified a Subsequent Environmental Impact Report (SEIR) (Environmental Assessment Review No. 16-55) for the Renaissance Specific Plan in accordance with the California Environmental Quality Act (CEQA). The proposed Easement was contemplated within the SEIR as necessary to support development within the specific plan.
