Request City Council to Award a Professional Services Agreement to Berg CM Corporation in the amount of $584,292.40 for Construction Management, Inspection and Materials Testing Services for the Alder Avenue and Randall Avenue Street Improvements Projects.

BACKGROUND:

In June 2017, the California Transportation Commission (CTC) initiated the process to implement the SB1 - Local Partnering Program by developing the Local Partnership Program Guidelines.  The Commission held multiple workshops between June 2017 and October 2017 to solicit input on the development of the Local Partnership Program Guidelines.  On October 18, 2017, The CTC adopted Guidelines for the three year, $300 million program.  Project nominations were due to the CTC on or before January 30, 2018.  The CTC received 90 projects nominations seeking over $900 Million.  On January 30, 2018, staff submitted a grant application for SB1 - Local Partnering Competitive Program Grant to improve safety for motorists and pedestrians traveling on Randall Avenue between Cactus Avenue and Riverside Avenue and on Alder Avenue between Baseline Road and Renaissance Parkway.

 

The City plans to widen both roadways to accommodate new travel lanes, bike lanes and edge improvements.  The City will install curb, gutter, and sidewalk to provide improved drainage and path of travel for vehicles, bicycles, and pedestrians.

 

ANALYSIS/DISCUSSION:

On October 17 and 18, 2018, the CTC selected and allocated $2,291,000 for the Randall Avenue and Alder Avenue projects.  The total Preliminary Construction Cost Estimate for the project is approximately $5,000,000.

 

On September 17, 2018, the City released Request for Proposal (RFP) No. 19-036 and posted it on PlanetBids.com.  On October 16, 2018, the City received nine (9) proposals from the following firms:

 

1.                     Transtech Engineers, Inc.

2.                     PPM Group Inc.

3.                     Berg CM

4.                     Willdan Engineering

5.                     4leaf Inc.

6.                     Syrusa Engineering Inc.

7.                     KOA Corporation

8.                     Wallace & Associates

9.                     SouthStar Engineering & Consulting

 

The City assembled an evaluation panel to review the proposals consisting of the Supervising Public Works Inspector from the City of Rancho Cucamonga, the Project Delivery Manager from San Bernardino County Transportation Authority (SBCTA), in addition to three City engineering staff members.

 

The evaluators were:

 

1.                     Rudy Linares, Supervising Public Works Inspector, City of Rancho Cucamonga

2.                     Tim Byrne, Project Delivery Manager, SBCTA

3.                     Hector Gonzalez, PE, Associate Civil Engineer, City of Rialto

4.                     Azzam Jabsheh, PE, Associate Civil Engineer, City of Rialto

5.                     Ted Rigoni, PE, Engineering Consultant to Rialto

 

Based on the judgment of the evaluators reviewing the proposals, a clear ranking of the most qualified firms was established and the top six (6) ranked firms were invited to interviews. 

 

The top six (6) firms were: 

 

                     Transtech Engineers, Inc.

                     PPM Group Inc.

                     Berg CM

                     Willdan Engineering

                     4leaf Inc.

                     Wallace & Associates

 

The City conducted interviews at the Public Works offices on December 19, 2018.  In accordance with state law (California Government Code Section 4526) and Chapter 2.48.440 of the Rialto Municipal Code, City Council must make the selection for professional services on the basis of the firm’s demonstrated competence and professional qualifications in accordance with specific evaluation criteria identified in the RFP.  The funding also requires the City to follow the qualifications-based consultant selection process outlined in the Caltrans Local Assistance Procedures Manual.

 

Based on the judgment of the evaluators, it was clear that Berg CM Corporation was most qualified to provide construction management services for the Alder Avenue/Randall Avenue Improvements project.  The City conducted a comprehensive background check and sent evaluation requests to the following agencies:

 

1.                     Port of Los Angeles

2.                     City of Fullerton

3.                     City of Beverly Hills

 

Berg CM received high ratings in categories such as, project management, communication, knowledge, experience, timeliness, budget and time and task management.  Berg CM provided construction management, inspections, and material testing services to SBCTA for the $35.7 Million interchange replacement project at the I-10/Riverside interchange.  During that project, SBCTA opened the Riverside Avenue interchange 15 days ahead of schedule in time for the City of Rialto Centennial Celebration.

 

Staff recommends selecting Berg CM to provide the requested services.  The proposed Professional Services Agreement (PSA) with Berg CM is included as Attachment 1.  Pursuant to the terms proposed in the PSA, the term of the PSA will be for one year.  A tabulation of the evaluation scores is included as Attachment 2.

 

Berg CM is well versed in providing construction management services and has completed similar services for the following agencies:

 

                     City of Beverly Hill

                     Port of Los Angeles

                     City of Fullerton

                     City of Santa Monica

 

 

The tentative schedule for the project is as follows:

 

RFB advertised:                     Feb 4, 2019

Contract award:                     March 26, 2019

Begin Construction:                     April 18, 2019

Complete Construction:                     April 17, 2020

 

 

ENVIRONMENTAL IMPACT:

The City prepared an Initial Study and Mitigated Negative Declaration (IS/MND) for the Randall Avenue Widening Project.  The City circulated the Initial Study for public review and comment for a 30-day period, from May 3, 2017 to June 3, 2017.  The City did not receive any comments.  The Development Review Committee reviewed the Randall Avenue Widening and approved a Mitigated Negative Declaration on May 3, 2017.  On May 3, 2017, the City filed a Notice of Determination (NOD) with the County Clerk.  Copies of the IS/MND and NOD are included as Attachments 3 &4.  The City prepared an Initial Study and Mitigated Negative Declaration (IS/MND) for the Alder Avenue Widening Project.  The City circulated the Initial Study for public review and comment for a 30-day period, from June 16, 2015 to July 16, 2015.  The City did not receive any comments.  The Development Review Committee reviewed the Alder Avenue Widening and approved a Mitigated Negative Declaration on June 16, 2015.  On June 17, 2015, the City filed a Notice of Determination (NOD) with the County Clerk.  Copies of the IS/MND and NOD are included as Attachments 5 & 6.

 

GENERAL PLAN CONSISTENCY:

This action is consistent with Guiding Principle 3A in the General Plan:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Approval of this action also complies with the following City of Rialto General Plan Goals and Policies:

 

Goal 3-6:                     Require that all developed areas within Rialto are adequately served with essential public services and infrastructure.

 

Goal 3-7:                     Upgrade public infrastructure as an inducement to promote private investment.

 

Goal 4-1:                     Provide transportation improvements to reduce traffic congestion associated with regional and local trip increases.

 

Goal 4-9:                     Promote walking.  Policy 4-9.3: Provide pedestrian-friendly and safety improvements, such as crosswalks and pedestrian signals, in all pedestrian activity areas.

 

LEGAL REVIEW:

The City Attorney has reviewed and approved the staff report and Professional Services Agreement.

 

FINANCIAL IMPACT:

Operating Budget Impact

The proposed action will not affect the Operating Budget.

 

Capital Improvement Budget Impact

Sufficient budget is available for the award with Berg CM to provide Construction Management, Inspection, and Material Testing, in the following accounts:

 

                     2005 TABS Bond Funds, Account No. 302-500-1799-3001-140801-16 for the Alder Avenue Widening Project No. 140801 in the amount of $292,146.20, and

 

                     Transportation DIF, Account No 250-500-4312-3001-140809-16 for the Randall Avenue Widening Project No. 140809 in the amount of $292,146.20. 

 

Licensing

A Business License application and payment of a Business License tax at the Professional Service rate in the amount of $654.00 will be paid by the vendor prior to execution of the Professional Service Agreement.

 

RECOMMENDATION:

Staff recommends that the City Council Approve a Professional Services Agreement in the amount of $584,292.40 with Berg CM for Construction Management, Inspection and Materials Testing services for the Alder Avenue and Randall Avenue Improvements Projects (Project No.’s 140801 & 140809).
