Title
Request City Council to Approve an Agreement with Pyro Spectaculars Inc. to provide a Pyrotechnics Display for the 2019 Rialto 4th of July Celebration, and Approve a Purchase Order to Pyro Spectaculars Inc. in the Amount of $25,750.

BACKGROUND:
The City of Rialto restricts personal firework use exclusively to devices and displays categorized as Safe and Sane by the California State Fire Marshal. In order to provide a more robust fireworks demonstration for community members and to discourage the use of illegal fireworks, the City will once again sponsor a professional pyrotechnic show as part of the July 4th event at Jerry Eaves Park.
ANALYSIS/DISCUSSION:
In accordance with the City’s purchasing rules, staff sent out Request for Proposals (RFP) to qualified businesses that provide pyrotechnic displays on February 13, 2019 (RFP #19-093) for the 2019 pyrotechnic show. 314 Vendors were notified, only 1 business responded to the RFP, (Pyro Spectaculars, responded to the request). The provided proposal (Attachment #2) is consistent with the 2019 bid and Pyro Spectaculars has provided a costs of $25,750 to provide the show.
Pyro Spectaculars is a large, reputable Fireworks Public Display Contractor that has headquartered their pyro technics business in the City of Rialto for decades. They are licensed to conduct pyrotechnic displays in the State of California, and possess the required levels of insurance for liability and workers compensation. Their proposal will provide a 20-minute show of aerial fireworks that will feature mortars ranging from 2.5 to 5 inches in diameter, which will ensure that spectators in Jerry Eaves Park will have a full view of the fireworks. They will also provide an option to choreograph the display to music. The proposal mirrors the 2018 show, which was well received by staff and community members in attendance. Pyro Spectaculars has completed the required conflict of interest disclosure form (Attachment #5).
ENVIRONMENTAL IMPACT:
The requested action is not a "Project" as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a "Project" means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.
GENERAL PLAN CONSISTENCY
This action is consistent with Guiding Principle 3A in the General Plan:
Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.
Approval of this action complies with the City of Rialto General Plan Goal and Policies:
Goal 3-11: Provide community facilities that adequately support established programs, can accommodate future needs, and are accessible to all members of the community.

FINANCIAL IMPACT:
Operating Budget Impact
Funds will be allocated in fiscal year 2019/20 Budget in Recreation Fund Account No. 640-500-8346-2021 for the $25,750 for the first year of the agreement.
Capital Improvement Budget Impact
This report does not have an impact on the Capital Improvement Budget.
Licensing
A Business license application and payment of a Business License tax at the Professional Service rate in the amount of $79 will be paid by the vendor prior to execution of the Purchase Order.
RECOMMENDATION:
Staff recommends that the City Council approve an agreement with Pyro Spectaculars to provide the display during the 2019 Rialto 4th of July Celebration, and approve a Purchase Order to Pyro Spectaculars Inc. in the Amount of $25,750.
