BACKGROUND:

On August 11, 2009, the City Council entered into an agreement with the firm of SAIC to    value the water and wastewater systems in preparation of entering into the Concession Agreement for the provision of water and wastewater operation services to the City of Rialto’s utility customers. 

 

The consulting team selected was led by Stephen Dopudja.  Mr. Dopudja is a Licensed Professional Engineer with over 28 years of experience managing water resources projects, including residential land development, planning and computer modeling of water and sewer systems, design and construction of water resource facilities such as pump stations, reservoirs and pipe lines.  He is also experienced in a variety of project delivery methods including design-build, traditional design-bid-build and public-private partnerships.  These skills have served the City well as we moved through the unique challenges presented through the Concession Agreement. 

 

In 2013, SAIC split into two divisions, SAIC and LEIDOS.  On October 8, 2013, City Council approved a 5-Year Professional Services Agreement (PSA) with LEIDOS Engineering, LLC for administrative oversight and professional engineering support services associated with the Concession Agreement utilizing the same consulting team.  In 2014, Mr. Dopudja and the team members went to work for West Yost Associates.  West Yost Associates was founded in 1990, focusing on exclusively on water, wastewater, recycled water, groundwater and stormwater.

 

Since 2009, the consultant team, led by Mr. Dopudja, has provided important and specialized engineering and services in support of the City’s efforts in overseeing the Concession Agreement and day to day utility operations.

 

With the proposed PSA, staff is recommending utilizing the same consultant team that has been providing specialized services to the City since 2009, through their current employer. 

 

 

 

ANALYSIS/DISCUSSION:

Staff is proposing awarding a new Professional Services Agreement to West Yost for continued technical assistance related to the Concession Agreement and additional engineering and specialized assistance needed in utility operations.  These services are described in the proposed PSA Scope of Services and Fees are included as Attachment 1.  The Disclosures Required by Persons or Entities Contracting with the City of Rialto form is included as Attachment 2.  

 

The significant items included in the Professional Services Agreement include:

                     Recurring activities and staff support related to the Concession Agreement

                     Engineering Studies and Planning Support Services

                     Second Triennial Inspection

                     Construction observation for Wastewater Treatment Plant Improvement Project

                     New editions of the Water and Wastewater Master Plans

                     Designs for the Agua Mansa and Sycamore Lift Stations.

 

The proposed PSA was presented to the Water Subcommittee on May 15, 2019, and the Utilities Commission on May 21, 2019.

 

ENVIRONMENTAL IMPACT:

This request is not a “Project” as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

 

GENERAL PLAN CONSISTENCY:

This action is consistent with Guiding Principle 3 in the General Plan:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

This action is also consistent with the following goals and policies:

 

Goal 3-6:                     Require that all developed areas within Rialto are adequately served with essential public services and infrastructure.

 

Policy 3-6.4:                     Complete infrastructure master plans for sewer, water and drainage.

 

Goal 3-8:                     Promote affordable and quality water service capable of adequately meeting normal and emergency water demands to all areas in Rialto.

 

Policy 3-8.1:                     Require that all new development or expansion of existing facilities bear the cost of expanding the water system to handle the increased demands which they are expected to generate.

 

Policy 3-8.4:                     Advocate regular evaluation of the entire water supply and distribution system to ensure its continued adequacy, reliability and safety.

 

Policy 3-8.5:                     Upgrade outdated and undersized water service facilities to prevent unnecessary system failures in the City’s water system.

 

LEGAL REVIEW:

The City Attorney has reviewed and approved the staff report and Professional Services Agreement. 

 

FINANCIAL IMPACT:

Operating Budget Impact

Sufficient funds in the amount of $755,000 will be available in the Fiscal Year 2019/2020 budget Account No. 660-500-7150-2011; $365,000 will be available in Account No. 670-500-7150-2011; and $400,000 will be available in Account No. 680-500-7860-2011 for the services described in the Professional Services Agreement.

 

Capital Improvement Budget Impact

There is no Capital Improvement Budget impact with the proposed action.

 

Licensing

Prior to execution of the Professional Service Agreement, the vendor shall submit a business license application and pay a Business License tax at the rate of $1,614.90, as well as Administration and State fees.

 

RECOMMENDATION:

Staff recommends that the City Council approve the Professional Services Agreement with West Yost Associates to Provide Technical and Engineering Consulting Services for Rialto Utility Authority and Utilities Division in the amount of $1,520,000.
