Request City Council to Adopt Resolution No. 7520 Accepting a Report on the Status of All State-Mandated Annual Fire Inspections in the City of Rialto in conjunction with SB1205 (COMPLIANCE REPORT FOR STATE-MANDATED ANNUAL FIRE INSPECTIONS) and the California Health and Safety Code Section 13146.4

 

Body

BACKGROUND:

The California Health & Safety Code Section 13146.4 was added in 2018, and became effective on September 27, 2018; and, Sections 13146.2 and 13146.3 requires all fire departments, including the Rialto Fire Department, that provide fire protection services to perform annual inspections in every building used as a public or private school, hotel, motel, lodging house, apartment house, and certain residential care facilities for compliance with building standards.

 

California Health & Safety Code Section 13146.2 requires all fire departments, including the Rialto Fire Department, that provide fire protection services to report annually to its administering authority on its compliance with Sections 13146.2 and 13146.3 and, the Council of the City of Rialto intends the attached Resolution to fulfill the requirements of the California Health & Safety Code regarding acknowledgment of the Rialto Fire Department’s compliance with California Health and Sections 13146.2 and 13146.3.

 

ANALYSIS/DISCUSSION:

Rialto Fire Department staff reporting in accordance with the California Health and Safety Code Sections 13146.2 and 13146.3 in the area encompassed by the City of Rialto, is as follows:

 

A.                     EDUCATIONAL GROUP E OCCUPANCIES:

Educational Group E occupancies are generally those public and private schools, used by more than six persons at any one time for educational purposes through the 12th grade.  Within the City of Rialto, there lie 36 Group E occupancies, buildings, structures and/or facilities.

 

During fiscal year 2018-2019, the Rialto Fire Department completed the annual inspection of 36 Group E occupancies, buildings, structures and/or facilities.  This is a compliance rate of 100% for this reporting period. 

 

B.                     RESIDENTIAL GROUP R OCCUPANCIES:

Residential Group R occupancies, are generally those occupancies containing sleeping units, and include hotels, motels, apartments (three units or more), etc. as well as other residential occupancies (including a number of residential care facilities).  These residential care facilities have a number of different sub-classifications, and they may contain residents or clients that have a range of needs, including those related to custodial care, mobility impairments, cognitive disabilities, etc.  The residents may also be non-ambulatory or bedridden.  Within the City of Rialto, there lie 380 Group R (and their associated sub-categories) occupancies of this nature.

 

During calendar year 2018, the Rialto Fire Department completed the annual inspection of 380 Group R occupancies, buildings, structures and/or facilities.  This is a compliance rate of 100% for this reporting period. 

                     

 

ENVIRONMENTAL IMPACT:

The request is not a Project as defined by Section 15378 of the California Environmental Quality Act (CEQA) Guidelines.  A “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  By definition, a Project does not include:  The creation of government funding mechanisms or other government fiscal activities which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment according to Section 15378 (b)(4) of the CEQA Guidelines.

 

GENERAL PLAN CONSISTENCY:

The City of Rialto has outlined key goals and objectives relating to public safety. This action is consistent with meeting these objectives.

  

5-3:1                     Provide for fire personnel, equipment, and fire stations to have adequate and appropriate resources to meet the needs and serve all areas of rialto.

 

5-8:                      Provide effective and comprehensive fire, EMS, and Disaster Preparedness services that meet the safety needs of Rialto.

 

LEGAL REVIEW:

The City Attorney has reviewed and approved this staff report and Resolution.

RECOMMENDATION:

Staff recommends that the City Council adopt a Resolution Accepting a Report on the Status of All State-Mandated Annual Fire Inspections in the City of Rialto in conjunction with SB1205 and the California Health and Safety Code Section 13146.4
