Request City Council to 1) Approve an Agreement with Pyro Spectaculars Inc., and 2) Approve a Purchase Order with Pyro Spectaculars in an Amount Not-To-Exceed $26,000 for the City July 4, 2021 Holiday Fireworks Presentation.

BACKGROUND

The City of Rialto restricts personal firework use exclusively to devices and displays categorized as Safe and Sane by the California State Fire Marshal.  In order to provide a more robust fireworks demonstration for community members and to discourage the use of illegal fireworks, the City will once again sponsor a professional pyrotechnic show as part of the July 4th event at Jerry Eaves Park. 

 

ANALYSIS/DISCUSSION

Staff solicited a proposal for the 2021 pyrotechnic show from Pyro Spectaculars.  The provided proposal (Attachment #1) is consistent with the 2021 bid and Pyro Spectaculars has honored previous pricing from 2017. The City Council has previously recommended that future shows be conducted on the Saturday of the 4th of July Holiday. Staff acquired two prices, one for $24,500 should the City schedule the event for July 3, 2021 and another for $26,000 should the City schedule the event for July 4, 2021. Staff will issue the purchase order for the price applicable to the date selected by the City.

 

Pyro Spectaculars is a large, reputable Fireworks Public Display Contractor that has headquartered their pyro technics business in the City of Rialto for decades.  They are licensed to conduct pyrotechnic displays in the State of California and possess the required levels of insurance for liability and workers compensation.  Their proposal will provide a 20-minute show of aerial fireworks that will mortars ranging from 2.5 to 5 inches in diameter, which will ensure that spectators in Jerry Eaves Park will have a full view of the fireworks.  They will also provide an option to choreograph the display to music.  The proposal mirrors the 2019 show, which was well received by staff and community members in attendance.

 

ENVIRONMENTAL IMPACT

The requested action is not a "Project" as defined by the California Environmental Quality Act (CEQA).  Pursuant to Section 15378(a), a "Project" means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.  According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

 

GENERAL PLAN CONSISTENCY

This action is consistent with Guiding Principle 3A in the General Plan: 

 Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Approval of this action complies with the City of Rialto General Plan Goal and Policies:

 

Goal 3-11:   Provide community facilities that adequately support established programs, can accommodate future needs, and are accessible to all members of the community.

Operating Budget Impact

Funds are allocated in Fiscal Year 2020-21 Budget in General Fund Account No. 010-500-8346-2021 for the not-to-exceed amount of $26,000

 

Capital Improvement Budget Impact

No impact to the Capital Improvement Budget.

 

Licensing

A Business license application and payment of a Business License tax at the Professional Service rate will be paid by the vendor prior to execution of the Purchase Order.

 

RECOMMENDATION

Staff recommends that the City Council:

 

                     Approve an Agreement with Pyro Spectaculars Inc., and

                     Approve a Purchase Order with Pyro Spectaculars in an amount not-to-exceed $26,000 for the City July 4, 2021 holiday fireworks presentation.
