BACKGROUND

In June 2017, the City of Rialto was chosen by the Board of State and Community Corrections, California (BSCC) to receive funding in the amount of $996,975 over a three (3) year period. The Prop 47 Grant project provides for the Rialto Juvenile T.E.A.M. (Training, Education, Alcohol/Drug, Mental Health Treatment) project, intended to service youth between the ages of 14 and 17 who are on probation or who have been arrested charged with, or convicted of a misdemeanor criminal offense and have a history of mental health issues and/or a substance use disorder. 

 

On June 11, 2019, the City Council adopted the one-year extension of the Board of State and Community Corrections, California Proposition 47 Program Grant Award through September 30, 2021 and authorized the issuance of annual purchase orders, in the amounts that are in excess of $15,000 for CBO’s for services associated with the Prop 47 Program Grant with an additional one year extension, without exceeding grant annual budget as stated in grant agreement; authorize the Mayor to execute each annual Prop 47 Program Grant agreement and any amendments she may deem advisable and authorize the City Administrator to be responsible for the administration of the grant.

 

During the City Council meeting held on April 13, 2021, the Council requested that staff bring this item back to the April 27, 2021 City Council meeting to receive a presentation on the Prop 47 Program from City staff and the CBO’s.

 

ANALYSIS/DISCUSSION

Staff is seeking Council approval to increase the cumulative contract amounts of the CBO’s agreements by $141,150, offset by reductions of $28,595 in City staff salaries and benefits charged to the Prop 47 program; $43,384 in professional services agreements related to grant administration; and $69,171 in indirect costs and other costs.

 

The request for the contract extension is based on the City Council approval of the one-year extension with the State of California Board of State and Community Corrections Agency and the CBO’s performance through the initial three years of the program.  The CBO’s are extremely familiar with the program’s regulations and requirements and is continuing services through virtual and limited contact methods through the pandemic. 

The reallocation of funding for the CBO’s is to accommodate the increased costs for the implementation of pandemic protocols, such as but not limited to; increased number of training sessions, costs for telecommuting services and materials and supplies assuming new service roles and costs to conduct services in the extension year.  In addition, two organizations, Inland Behavioral Health Services and 100 Black Men, have limited their interests or is not able to commit to our program needs at this time.  Due to their change in status, two current CBO’s, Clay Counseling and Rialto Family Health Services, have the training and credentials to assume case management, intake evaluation and clinical assessment and will receive the portion of the remaining balance of funds for the discontinued services from IBHS and 100 Black Men, while the remaining funds will be reallocated to other existing CBO’s to meet their anticipated budget needs for increased services and costs due to the implementation of pandemic protocols and additional program year.

 

The state has approved the proposed line-item budget modification and the City Attorney prepared the CBO MOU Amendments for the Interim City Manager’s approval as the BCSS’s authorized official.

 

ENVIRONMENTAL IMPACT

The request is not a Project as defined by Section 15378 of the California Environmental Quality Act (CEQA).

 

GENERAL PLAN CONSISTENCY

The City of Rialto has outlined key goals and objects relating to public safety.  The acceptance of the Prop 47 Grant Program award is consistent with meeting the following goals and objectives:

 

Goal 5-8:  Provide effective and comprehensive policing services that meet the safety needs of Rialto.

 

Policy 5-8-1:  Provide timely responses to emergency and nonemergency calls for services 24 hours a day, per the City standards.

 

LEGAL REVIEW

The City Attorney has reviewed and supports this staff report.

 

FINANCIAL IMPACT

The reallocation of Prop 47 funds between CBO’s and other line items within the Prop 47 program does not affect the total funding of $996,975 awarded to the City of Rialto.  As such, there is no fiscal impact to the operating and capital budgets of the City. 

 

RECOMMENDATION

Staff recommends the City Council:

                     Receive a presentation on the Proposition 47 Program from City staff and the Community Based Organizations (CBO’s) and,

                     Amend the Proposition 47 Memorandum of Understanding (MOU) Agreements with the CBO’s to reallocate resources to achieve the pre-established goals of the Prop 47 Program.
