BACKGROUND

The Rialto Police Department over the last several years has provided contract services to local businesses to provide uniformed presence and traffic control.

 

The Rialto Police Department works with the local business to develop a customized plan for these types of services. These plans may vary from one business to the next, depending on the type of service requested as well as the goals of the business.

 

ANALYSIS/DISCUSSION

The Rialto Police Department routinely contracts with nonprofit organizations and local businesses to offer services consistent with the needs of these organizations or businesses and aligned with the goals of the City. Amazon Distribution Center-LGB7 located in the Renaissance Specific Plan historically reaches out to the Rialto Police Department to provide traffic control during their Peak Seasons and Prime Day events.  The influx of commercial traffic during these events creates hazards on the roadways surrounding the Amazon warehouses. The traffic control provided by the Police Department ensures the safety of not only the citizens of Rialto, but the employees of Amazon. 

 

Amazon has requested the services of the Rialto Police Department to provide formalized traffic control during the holiday season, a time of highest activity for Amazon. Specifically, the term of this Agreement shall be from November 20, 2021, through December 24, 2021. Based on this Agreement, the City shall provide the following services (“Services”):

 

                     Four (4) sworn peace officers or corporals to provide setup of barriers and cone patterns on November 20, 2021, from 7:00 AM to 11:00 AM at the Amazon Distribution Center - LGB7 located at 1660 N. Linden Avenue in the City of Rialto.

 

                     Four (4) sworn peace officers or corporals to provide breakdown of barriers and cones patterns on December 24, 2021, from 07:00 Am to 11:00 AM at the Amazon Distribution Center - LGB7 located at 1660 N. Linden Avenue in the City of Rialto.

 

                     The two (2) sworn peace officers or corporals will provide traffic control services during two (2) shifts, every day starting November 21, 2021, and concluding on December 23, 2021.  One shift will be from 4:00 AM to 8:00 AM, and the second shift will be from 4:00 PM to 8:00 PM.

 

                     The sworn peace officers or corporals shall provide the traffic control services at the Amazon Distribution Center - LGB7 located at 1660 N. Linden Avenue in the City of Rialto.

 

Amazon.com, Inc. agrees to pay for the services at the fully burdened rate of the sworn police officer or corporal, which is equal to $289.88 per hour. Staff will invoice Amazon for the estimated fully burdened reimbursement costs for all services contemplated by this Agreement, not to exceed $162,332.80.

ENVIRONMENTAL IMPACT

The proposed action does not meet the definition of a project as defined by Section 15378 California Environmental Act (CEQA).  A “Project” means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and excludes the following:

 

1.                     Continuing administrative or maintenance activities, such as purchases for supplies, personnel-related actions, general policy and procedure making.

 

2.                      Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

 

GENERAL PLAN CONSISTENCY

The City of Rialto has outlined key goals and objectives relating to public safety.

 

Goal 5-8: Provide effective and comprehensive policing services that meet the safety needs of Rialto.

 

Policy 5-8.4: Initiate proactive crime suppression and prevention strategies throughout the community.

 

LEGAL REVIEW

The City Attorney has reviewed and supports this staff report.

 

FINANCIAL IMPACT

Operating Budget Impact

Approval of the agreement will increase estimated revenues in the amount of $162,335 to the General Fund Account No. 010-400-6288-7520, while increasing overtime expenditures in the amount of $58,685 in the General Fund Account No. 010-500-6288-1020.

Capital Improvement Budget Impact

This report does not impact the Capital Improvement Budget.

 

Licensing

This action does not trigger a requirement for a business license.

 

RECOMMENDATION

Staff recommends that the City Council:

(1) Adopt Resolution No. ____ Amending the 2021-2022 Fiscal Year Budget;

(2) Approve an Agreement for Traffic Control Services Between Amazon.com, Inc. and the City of Rialto for the Period November 20, 2021, through December 24, 2021, at a Fee of $162,332.80; and

(3) Authorize the City Manager to Execute All Documents
