BACKGROUND:

The intersection of Ayala Drive and Fitzgerald Avenue currently operates as a non-signalized intersection.  The four (4) roadways approaching the intersection curve to the right before reaching the intersection.  Vehicles approaching the intersection from Fitzgerald Avenue must first stop upon reaching Ayala Drive, then are expected to proceed into the intersection when it is safe to do so. The majority of the traffic is on Ayala Drive where vehicle speeds are noticeably high.

 

The goal of the Ayala Drive and Fitzgerald Avenue Traffic Signal Project is to install traffic signalization and street lighting improvements to increase safety of pedestrians and motorists travelling through the area.  The final design was verified to be in compliance with the Americans with Disabilities Act (ADA), providing pedestrian access and connectivity to and from the Renaissance Marketplace shopping center, Jerry Eaves Park, the 210 Freeway and adjacent areas.

 

On August 11, 2020, the City adopted the Fiscal Year 2020/2021 Budget and Capital Improvement Project List which included the Fitzgerald Avenue Traffic Signal and Lighting Improvement Project, City Project No. 190810 (the “Project”).

 

On February 22, 2022, the City Council approved the plans and authorized bidding of the Project.

 

ANALYSIS/DISCUSSION:

The City released RFB No. 22-003 for the Ayala Drive and Fitzgerald Avenue Traffic Signal and Lighting Improvement Project, City Project No. 190810, and published the Notice Inviting Bids on the PlanetBids.com website.

 

On September 6, 2022, the City received ten (10) bids, tabulated in Table 1 below:

 

 

A full bid summary is included as Attachment 1.  The engineer’s estimate was $445,500.  The lowest responsible and responsive bid was $466,066 submitted by PTM General Engineering Services, Inc. (PTM).  Staff reviewed the bid and found PTM General Engineering Inc. to be properly licensed and qualified.  PTM’s Disclosure Statement, Contractor’s License and DIR verification documents are included as Attachment 2.  Staff recommends that the City Council accept the bid received from PTM as the lowest responsible and responsive bid and award a construction contract with PTM for the project is included as Attachment 3.

 

ENVIRONMENTAL IMPACT:

Section 21084 of the California Public Resources Code requires that the guidelines for implementation of the California Environmental quality (CEQA) include a list of classes of projects that have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have significant effect on the environment and are declared categorically exempt from the requirement for the preparation of environmental documents. In accordance with 14 CCR Section 15301 “Existing Facilities”, Class 1 projects consist of the repair, maintenance, or minor alteration of existing structures and facilities’ therefore, the installation of a traffic signal and street lighting for Ayala Drive & Fitzgerald Avenue Signal and lighting Improvements, City Project No. 190810 is considered categorically exempt from CEQA. Staff has prepared and will file a Notice of Exemption for the project, included as Attachment 4.

 

GENERAL PLAN CONSISTENCY:

The City of Rialto General Plan establishes various guiding principles, goals and objectives through which the City looks to improve the community and protect the quality of life for our residents. This action is consistent with Guiding Principle 3A in the General Plan:

 

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

Approval of this action also complies with the following City of Rialto General Plan Goals and Policies:

 

Goal 3-6:                      Require that all developed areas within Rialto are adequately served with essential public services and infrastructure.

 

LEGAL REVIEW:

The City Attorney has reviewed and supports this staff report.

 

FINANCIAL IMPACT:

Operating Budget Impact

The proposed action will not affect the Operating Budget.

 

Capital Improvement Budget Impact

This project is included in the Capital Improvement Budget.

 

The Construction Contract with PTM General Engineering Services, Inc. in the amount of $466,066 will be funded from the Fair Share Account, Account Number 301-500-4312-3001-190810-05 for the project.

 

Licensing

A Business License Tax at the Professional Services rate in the amount of $529 based on the construction amount of $466,066 will be assessed against the project and paid by interoffice transfer.

 

RECOMMENDATION:

Staff recommends that City Council:

 

                     Award a Construction Contract to PTM General Engineering Services, Inc. in the amount of $466,066.00 for Ayala Drive and Fitzgerald Avenue Traffic Signal and Lighting Improvement Project, City Project No. 190810.

                     Authorize the City Manager to Execute all Documents.
