BACKGROUND:

The City Council previously requested that Staff pursue completion of the widening of Merrill Avenue adjacent to the property located at 1193 W. Merrill Avenue. At the time the larger Merrill Avenue widening was designed and constructed, this limited 98 feet wide parcel was not included in the project due to lack of public right-of-way at the time. As a result, the street and sidewalk improvements adjacent to this property are incomplete as shown in the photo below.

 

 

This result should not have occurred and moving forward Staff will ensure that street widening projects include all parcels along a corridor, including those without the required right-of-way.

 

At City Council’s direction, Staff has pursued negotiations with the property owner to acquire the needed right-of-way to complete the street widening at this location. The property owner has agreed to grant right-of-way to the City for the purpose of street widening and construction of street improvements in exchange for the City constructing certain improvements on the private property (driveway, block wall, tubular steel gates, and related grading).

 

On February 9, 2021, the City Council awarded a professional services agreement to Huitt-Zollars, Inc. in the amount of $46,500 for design of the 1193 W. Merrill Avenue Widening Project.

 

On February 8, 2022, the City Council approved the plans and authorized bidding of the project.

 

ANALYSIS/DISCUSSION:

On October 12, 2022, the City released RFB No. 23-008 for 1193 W Merrill Avenue Street Widening, City Project No. 210812, and published the Notice Inviting Bids on the PlanetBids.com website.

 

On September 13, 2022, the City received three (3) bids, tabulated in Table 1 below:

 

 

A full bid summary is included as Attachment 1.  The engineer’s estimate was $531,000.  The lowest responsible and responsive bid is $213,220 submitted by Roadway Engineering & Construction Corp.  Staff reviewed the bid and found Roadway Engineering & Construction Corp to be properly licensed and qualified.  The contractor’s Disclosure Statement, Contractor’s License and DIR verification documents are included as Attachment 2.  Staff recommends that the City Council accept the bid received from Roadway Engineering & Construction Corp as the lowest responsible and responsive bid and award a construction contract with Roadway Engineering & Construction Corp for the project; a copy of the contract is included as Attachment 3.

 

ENVIRONMENTAL IMPACT:

Section 21084 of the California Public Resources Code requires that the guidelines for implementation of the California Environmental quality (CEQA) include a list of classes of projects that have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have significant effect on the environment and are declared categorically exempt from the requirement for the preparation of environmental documents. In accordance with 14 CCR Section 15301 “Existing Facilities”, Class 1 projects consist of the repair, maintenance, or minor alteration of existing structures and facilities’ therefore, the installation of a traffic signal and street lighting for Ayala Drive & Fitzgerald Avenue Signal and lighting Improvements, City Project No. 190810 is considered categorically exempt from CEQA. Staff has prepared and will file a Notice of Exemption for the project, included as Attachment 4.

 

GENERAL PLAN CONSISTENCY:

The City of Rialto General Plan establishes various guiding principles, goals and objectives through which the City looks to improve the community and protect the quality of life for our residents. This action is consistent with Guiding Principle 3A in the General Plan:

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Approval of this action also complies with the following City of Rialto General Plan Goals and Policies:

 

Goal 4-1:                     Provide transportation improvements to reduce traffic congestion associated with regional and local trip increases.

 

Policy 4-1.1:                     Establish and maintain standards for a variety of street classifications to serve both local and regional traffic, including Major Arterial Highways, Major Arterials, Secondary Arterials, Collector Streets, and Local Streets.

 

LEGAL REVIEW:

The City Attorney has reviewed and recommends approval of this staff report and contract.

 

FINANCIAL IMPACT:

Operating Budget Impact

The proposed action will not affect the Operating Budget.

 

Capital Improvement Budget Impact

This project is included in the Capital Improvement Budget.

 

The Construction Contract with Roadway Engineering & Construction Corp in the amount of $213,220 will be funded from the Measure I Fund, Account No. 201-500-4310-2011-210812 for the Merrill Avenue Widening Project, City Project No. 210812.

 

Licensing

A Business License Tax at the Professional Services rate in the amount of $279 based on the construction amount of $213,220 will be assessed against the project and paid by interoffice transfer.

 

RECOMMENDATION:

Staff recommends that City Council:

(1) Award a Construction Contract to Roadway Engineering & Construction Corp, a California corporation, in the amount of $213,220 for the 1193 W Merrill Avenue Widening, City Project No. 210812; and

(2) Authorize the City Manager to Execute all Documents
