BACKGROUND:

On September 14, 2021, the City Council awarded a construction contract for the Riverside Avenue North Reconstruction (SR210 to Foothill Boulevard), Project No. 210807.  The project includes complete reconstruction through Full-Depth Reclamation (FDR) to provide a brand-new street.  At that time, City Council questioned why all segments of Riverside Avenue were not programmed for reconstruction, and as a condition of the award of the construction contract for the Riverside Avenue North Reconstruction project, directed Staff to immediately program a project to reconstruct the segment of Riverside Avenue from the Metrolink tracks south to San Bernardino Avenue.

 

As part of that action, the City Council delegated authority to the City Manager to enter into a design contract with Advanced Civil Technologies (ACT), the design consultant preparing plans, specifications and estimates (PSE) for the Riverside Avenue reconstruction projects.

 

On October 26, 2021, the City Council received a presentation on the General Fund Ending Fiscal Year 2020-2021 financial report and using carry-over funds approved amending the Fiscal Year 2021/2022 General Fund budget to appropriate $10 million for additional street paving repairs, with $6 million programmed for the Riverside Avenue Central Reconstruction (Metrolink Tracks to San Bernardino Avenue), Project 220804 (the “Project”).

 

On June 14, 2022, the City Council approved plans and specifications and authorized the release of request for bids for the Riverside Avenue Central Reconstruction Project, City Project No. 220804 and authorized a purchase order in the amount of $310,942 with Fountainhead Consulting Corporation, pursuant to the City’s “on-call” agreement for construction management, inspection, materials testing services for the Project.

 

ANALYSIS/DISCUSSION:

On August 9, 2022, the City released RFB No. 23-006 for the Riverside Avenue Central Reconstruction Project, City Project No. 220804, and published the Notice Inviting Bids on the PlanetBids.com website.

 

On September 13, 2022, the City received seven (7) bids, tabulated in Table 1 below:

 

A full bid summary is included as Attachment 1.  The engineer’s estimate was $4,100,000.  The lowest responsible and responsive bid is $3,961,071 submitted by Matich Corporation.  Staff reviewed the bid and found Matich Corporation to be properly licensed and qualified.  Matich Corporation’s Disclosure Statement, Contractor’s License and DIR verification documents are included as Attachment 2.  Staff recommends that the City Council accept the bid received from Matich Corporation as the lowest responsible and responsive bid and award a construction contract with Matich Corporation for the project is included as Attachment 3.

 

Staff also recommends that the City Council authorize the City Manager to review and approve contract change orders in a cumulative amount not to exceed $400,000.

 

ENVIRONMENTAL IMPACT:

Section 21084 of the California Public Resources Code requires that the guidelines for implementation of the California Environmental quality (CEQA) include a list of classes of projects that have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment and are declared categorically exempt from the requirement for the preparation of environmental documents. In accordance with 14 CCR Section 15301 “Existing Facilities”, Class 1 projects consist of the repair, maintenance, or minor alteration of existing structures and facilities; therefore, Riverside Avenue Central Reconstruction, Project No. 220804 is considered categorically exempt from CEQA. Staff has prepared and will file a Notice of Exemption for the project, included as Attachment 4.

 

GENERAL PLAN CONSISTENCY:

The City of Rialto General Plan establishes various guiding principles, goals and objectives through which the City looks to improve the community and protect the quality of life for our residents. This action is consistent with Guiding Principle 3A in the General Plan:

Our City government will lead by example, and will operate in an open, transparent, and responsive manner that meets the needs of the citizens and is a good place to do business.

 

Approval of this action also complies with the following City of Rialto General Plan Goals and Policies:

 

Goal 3-11:                     Provide community facilities that adequately support established programs, can accommodate future needs, and are accessible to all members of the community.

 

Goal 3-11.1:                     Allocate resources for the maintenance and operations of City facilities; explore alternative funding options for maintenance and operational costs of new facilities.

 

Policy 4-1.1:                     Establish and maintain standards for a variety of street classifications to serve both local and regional traffic, including Major Arterial Highways, Major Arterials, Secondary Arterials, Collector Streets, and Local Streets.

 

LEGAL REVIEW:

The City Attorney has reviewed and supports this staff report.

 

FINANCIAL IMPACT:

Operating Budget Impact

The proposed action will not affect the Operating Budget.

 

Capital Improvement Budget Impact

On October 26, 2021, the City Council programmed $6 million from the General Fund to the Capital Fund, Account No. 300-500-7305-3001 for the construction of Riverside Avenue Central Reconstruction, Project No. 220804. The estimated costs of the Project are provided in the following Table.

 

 

Award of the Construction Contract with Matich Corporation in the amount of $3,961,071 will be funded from the Capital Fund, Account No. 300-500-7305-3001-220804-16 for Riverside Avenue Central Reconstruction Project, City Project No. 220804.

 

Licensing

A Business License Tax at the Professional Services rate in the amount of $454 based on the construction amount of $3,961,071 will be assessed against the project and paid by interoffice transfer.

 

RECOMMENDATION:

Staff recommends that City Council:

(1) Award a Construction Contract to Matich Corporation, a California corporation, in the amount of $3,961,071 for the Riverside Avenue Central Reconstruction Project, City Project No. 220804;

(2) Delegate Authority to the City Manager to Approve Contract Change Orders in the Cumulative Amount of $400,000; and

(3) Authorize the City Manager to Execute all Documents
